Being that same certain tract or parcel of land heretofore conveyed to Donald Jack Mullins, II, and Ginger Lea Mullins, his wife, by Deed dated September 24, 2008, from Sandra Lea Mullins of record in the Clerk’s Office of the Circuit Court for Wise County, Virginia, as Instrument Number 200804268. Tax ID No. 040925.

There is excepted and reserved from this conveyance such of the coal, oil, gas, minerals, rights, privileges, etc., that have been heretofore sold or excepted from said property. This property is made subject to and/or benefit of those additional superior liens, mechanics’ liens, restrictions, covenants, easements, rights of way, and conditions applicable to said real estate, if any there be, as contained in prior deeds properly of record.

Deposit of $2,000.00 cash or check drawn upon certified funds (no personal or cashier’s checks drawn upon uncertified funds accepted without prior Trustee approval) for the bid shall be required to qualify as a bidder before the sale, except from the Noteholder, or a deposit of 10% of the sale price, whichever is lower. PUBLIC NOTICE

Notice is hereby given that The Banner Company of 110 Sprint Drive, Blountville, TN intends to conduct blasting activities on Surface Mine Permit/Application No. 1101763. Proposed mine operation will be located near the headwaters of Coon Branch and along the ridgeline between the watersheds of Neece Creek and Coon Branch of McClure River, off state route 652.

All blasting shall be conducted in accordance with the following schedules of dates and times, unless emergency conditions dictate unscheduled detonation. Blasting will be conducted during daylight hours, between sunrise and sunset, six (6) days a week, Monday through Saturday. This notice shall be in effect for 12 months from date of publication.

Public access to the area prior to blasting will be controlled by barricading all access roads. The pre-blast audible warning shall consist of three minutes prior to blast. A warning sign audible to a range of one-half mile from blast site will be given - three long signals of five seconds duration with five seconds between each signal indicate clear the area. After the area has been cleared, two (2) long signals, indicate ready to fire, wait two (2) minutes, one (1) long signal, fire. The "All Clear" signal shall consist of three short signals on the air horn/siren.

Mountain Empire Older Citizens, Inc. proposes to continue the provision of transportation services for the elderly, persons with disabilities and the general public in the Counties of Lee, Scott and Wise and the City of Norton. These persons are transported to and from training, nutrition, and other community integration and socialization projects. Funds are being requested through the Commonwealth of Virginia, Department of Rail and Public Transportation from the Federal Transit Administration 5317, Federal Transit Administration 5311 program and State Aid for the Public Transit Program for operating expenses, enhancing mobility management program, purchase of 5 replacement, lift equipped body-on-chassis buses, two-way radios and miscellaneous equipment. Maximum federal financial participation shall be 80% of capital and 50% of operating expenses.

Interested persons, groups or organizations of any kind within the Lee, Scott and Wise County and City of Norton service area wishing to comment on the proposed application may do so by attending a Public Hearing in the Transit Conference Room at Mountain Empire Older Citizens, Inc., 1520 3rd Ave. E., Big Stone Gap, Virginia 24219 on Thursday, January 31, 2013 at 2:00 P.M. or by sending a written notice by January 25, 2013 to: Mitch Elliott, Transportation Director, MEOC, P.O. Cumberland River Coal Company, P. O. Drawer 109 Appalachia, Virginia 24216 is applying to the Virginia Division of Mined Land Reclamation for Phase II bond release on Increments No. 2 and No. 6 of Permit No.1601486 located in Wise County approximately 2 Miles North of Dunbar, Virginia on Potcamp Fork. The post mining land use for this permit area is unmanaged forest. The northing and easting are approximately 3555000 and 10245000, respectively. The permit area consists of 1646.34 Pool Bonded acres. The Whitesburg, KY and Appalachia, Norton, and Flat Gap, VA USGS 7.5-minute topographic maps were used to describe the location of the permit area.

As provided by § 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $2,708,400.00 in the form of a Surety posted for this permit be reduced by $924,050. This bond release request on Increment No. 2 and No. 6 is based upon the acceptable growth of both grasses and tress within both Increment areas.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any Federal, State, or Local Government agency or authority may within 30 days of January 11, 2013 submit written comments or objections, concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation’s office in Big Stone Gap, Virginia.

The Town of Appalachia is anticipating submitting a grant proposal to the Virginia Transportation Enhancement Program for the Powell River Trail Project. This application will be submitted on or before February 1, 2013. A public meeting will be held on Tuesday, January 15, 2013 at 10:00 a.m. at the Appalachia Town Hall building in Appalachia, Virginia. Those interested in this funding application or who would like to express public opinion are encouraged to attend.
