Paramont Coal Company Virginia, LLC, 5703 Crutchfield Drive, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation (VDMLR) for a Phase 1 bond reduction on Bonding Increments I, III, IV, V and Phase III on Bonding Increment II for Permit No. 1101849 at the following location: Wise and Dickenson Counties, 2.5 miles east of Pound, Virginia on Georges Fork. This permit consists of 740.07 acres. As provided by 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $2,223,000 in the form of insurance surety posted for Phase I be reduced by $1,175,400 and Phase III to be released for $264,000.

This bond reduction request is based on the following Phase I reclamation:

Types of Reclamation Work Performed - the areas proposed for bond release/reduction have been reclaimed, revegetated, and the post-mining land uses have been achieved.

Appropriate Date(s) of Reclamation Work Performed – the reclamation work was completed June 2013.

Description of Reclamation Results Achieved The area proposed for post-mining land use of Commercial and Industrial –Manufacturing has been reclaimed and revegetated to meet the requirements of the mining permit and will be released to Dickenson County Industrial Development Authority upon release from the DMLR. The area proposed for a post-mining land use of Residential has an occupied dwelling. The area proposed for a post-mining land use Agricultural – Grazingland, Fish and Wildlife Habitat – Wetlands, Residential and Unmanaged Forest/Undeveloped Land has been revegetated with the appropriate ground control species and has been revegetated with trees.

Description of the Post-Mining Land Use - Agricultural – Grazingland, Fish and Wildlife Habitat – Wetlands, Residential and Unmanaged Forest/Undeveloped Land.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any federal, state or local government agency or authority, may within 30 days after October 25, 2013 submit written comments or objections concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. Maggard Branch Coal LLC is applying for Phase 1 bond reduction on Permit No. 1201828 located in Wise County approximately 7.0 miles north of Appalachia off route 685 on Mud Lick Creek. This permit consists of 11.67 of which only 3.33 acres have been disturbed. As provided by 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $40,000.00 (for the entire permit area) in the form of insurance surety posted for this permit be reduced by $24,000.00.

This bond reduction request is based on completion of the following reclamation:

1. Backfilling and regrading, topsoil placement, vegetation and tree planting.

2. Reclamation completed and approved 6-14-13.

3. All areas have been stabilized and drainage control established.

Cumberland River Coal Company, P. O. Drawer 109 Appalachia Virginia 24216 is applying to the Virginia Division of Mined Land Reclamation for the renewal of the above captioned permits. The permit is located Wise County approximately 2 Miles North of Dunbar, Virginia on Potcamp Fork. The northing and easting are approximately 3555000 and 10245000, respectively. The permit area consists of 1646.34 pool bonded acres. The Whitesburg, KY and Appalachia, Norton, and Flat Gap, VA USGS 7.5-minute topographic maps were used to describe the location to the permit area.

Drainage and wastewater from the mining operation is being controlled by approved sediment control structures and then discharges into Potcamp Fork and Roaring Fork.

A copy of the renewal materials will be available for inspection and public comment at the Circuit Court Clerk’s Office at Wise County Courthouse at Wise, Virginia. Any person whose interests are or may be adversely affected by the proposed operation, or any officer or head of any Federal, State, or Local Government agency or authority may within 30 days of October 11, 2013 submit written comments or objections, concerning the proposed operation, and may also request, in writing, that the Division of Mined Land Reclamation hold an informal conference.
