TITLE 45.1 OF THE CODE OF VIRGINIA

PUBLICATION NUMBER 13DXB03

Paramont Coal Company Virginia, LLC of 5703 Crutchfield Drive, Norton, VA 24273 is applying to the Virginia Division of Mined Land Reclamation to amend 27.59 acres to Permit Number 1301873. The revision will amend Permit No. 1201858, which includes existing NPDES Outfalls 001& 003. A new raw coal material handling system will be constructed and the existing clean coal material handling system will be expanded. The permit covers 441.30 acres located in Wise County, 2 miles N of Coeburn, VA off Route 652 on Toms Creek. It appears on the Coeburn 7.5 U.S.G.S. Quadrangle at latitude 36˚ 58' 08", longitude 82˚ 27' 24".

Drainage and waste water resulting from the permitted operation will be discharged as follows:

A copy of the application materials is available for public inspection and comment at the Wise County Courthouse. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the proposed revision, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of March 19, 2013 submit written comments or objections to the Division of Mined Land Reclamation concerning the proposed revision; and may also request, in writing, that the Division hold an Informal Conference concerning the application. Paramont Coal Company Virginia, LLC, is applying for bond release on Permit No. 1401857, located in Wise County, 3 miles NE of Wise, VA off Route # 643 on Rock Creek. This permit consists of 11.67 acres. As provided by 4VAC25-130.800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the applicant is requesting that the current total bond amount of $14,000 in the form of an insurance surety, posted for this permit, be released.

This bond release request is based on the following Phase III reclamation:

1. Backfilling, regrading, topsoiling and hydroseeding of the disturbed areas.

2. Final hydroseeded was performed on 08/25/03 and trees planted on 03/03/04.

3. All disturbances have been revegetated.

4. The post-mining land uses of unmanaged forest, fish & wildlife habitat-wetlands and industrial-gas wells/pipelines have been successfully implemented.

Any person with a valid legal interest which may be adversely affected by this proposal, or an officer or head of any federal, state or local government agency or authority may within 30 days of March 12, 2013 submit written comments or objections concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation’s office in Big Stone Gap, Virginia.

PROPOSE FOR PASSAGE A RESOLUTION AUTHORIZING THE ISSUANCE OF A SOLID WASTE REVENUE BOND IN A PRINCIPAL AMOUNT NOT TO EXCEED $4,200,000

Notice is hereby given to all interested persons of a public hearing of the Board of Supervisors (the “Board”) of the County of Wise, Virginia (the “County”), to be held on Thursday, March 14, 2013 at 6:00 p.m. or as soon thereafter as possible in the Juvenile & Domestics Relations Court/Board Meeting Room (Room 141), 206 East Main Street, Wise, Virginia 24293, concerning the intention of the Board to propose for passage a resolution entitled “A Resolution of the County of Wise, Virginia, Authorizing the Issuance and Sale of a Not to Exceed $4,200,000 Solid Waste Revenue Bond, Series 2013, and Providing for the Form, Details and Payment Thereof,” authorizing the issuance of a solid waste revenue bond of the County of Wise, Virginia in the estimated maximum amount of $4,200,000. The proposed use of the bond proceeds is to finance construction, renovation and expansion to the County’s solid waste system and related legal, consulting and administrative fees. Persons may appear and present their views at the public hearing.
