ORDER

The General Receiver of this Honorable Court holds certain funds pursuant to Orders of this Court in case number CH03-254 styled Estate of Joe Bell vs. Elizabeth Ann Norfleet, et als, and the Estate of Joe Bell, court file no.: 03-96, for the benefit of Earnest Gardner, who is now deceased.

The object of the above-styled suit is to determine the heris of the Estate of Earnest Gardner (deceased) and their share of the monies held by the General Receiver for the purposes of distribution. The Court having found that while certain heirs are presently known and have made claim to the property being held, other heirs may exist and are unknown at this time.

It appearing by affidavit of Charles Herbert Slemp, III, General Receiver, filed according to law that the potential beneficiaries are “parties unknown” at the present as unknown ptoential beneficiaries of the funds held, it is, therefore,

ORDERED that the said unknown heirs appear on or before the 8th day May, 2013, in the Clerk’s Office of this Court and do what is necessary to protect his interests.

And, it is further, ORDERED that this order be published once a week for four successive weeks in (i) the Coalfield Progress of Norton, Virginia, a newspaper of general circulation in the County of Wise and City of Norton, Virginia, (ii) in the Bluefield Daily Telegraph, Bluefield, West Virginia, and (iii) in the Cincinnati Enquirer, Cincinnati, Ohio, a newspaper of general circulation in greater Cincinnati, Hamilton County, Ohio and Boone County, Kentucky; that a copy of this order be posted at the front door of the courthouse wherein this court is held. Paramont Coal Company Virginia, LLC, 5703 Crutchfield Drive, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation (VDMLR) for a Final Bond Release on Permit No. 1201829, Ambrose Branch Deep Mine, by Application 1008476. The site is situated in Wise County, 1.3 miles northeast of Bean Gap on Ambrose Branch, off State Route 673. The Pound, Virginia USGS 7.5 minute topographic quadrangle map was used to describe the location of the permit area. The site is at northing 3,572,440 and easting 10,294,325.

The permit consists of approximately 20.97 acres which are cost bonded for $143,400. As provided by 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $143,400, be released.

The bond release request is based upon the following reclamation:

1. The permit area has been regraded and revegetated.

2. The permit area was revegetated in April 2010 (remining).

3. The post-mining land uses of “Agricultural-Grazing Land” and “Fish and Wildlife Habitat-Species Managed Area” have been achieved.

A copy of the application materials will be available for inspection and public comment at VDMLR’s Big Stone Gap office. Any person whose interests are or may be adversely affected by this proposal, or any Officer or Head of any Federal, State, or Local Government agency or authority may within 30 days of April 2, 2013 submit written comments or objections to VDMLR concerning the proposed operation and may also request, in writing, that VDMLR hold an informal conference concerning the application. The application proposes to refocus a portion of the Wise County Landfill-Blackwood Site from a landfill to a Landfill Gas Collecting System and Class A Municipal Sludge Treatment and Drying Facility. The proposal is being considered an Experimental Practice in accordance with 4 VAC 25-130-785.13 of the Virginia Coal Surface Mining Reclamation Regulations, which will leave exposed highwalls on a portion of the landfill site originally designated to be eliminated with landfill waste. The exposed highwalls will remain in order to facilitate the construction and operation of the proposed facilities.

The site is located approximately 3 miles West of the City of Norton, VA, just North of US Alternate 58, near the Wise County Community of Blackwood at the current Wise County Blackwood Landfill Site. The site is located on Norton U. S. Geological Survey 7.5 minute quadrangle map.

A copy of the application materials is available for public inspection and comment at the Virginia Division of Mined Land Reclamation office located at 3405 Mountain Empire Road, Big Stone Gap, VA 24219. Any person whose interests are or may be adversely affected by the proposed application, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of April 23, 2013 submit written comments or objections to the Division of Mined Land Reclamation concerning the proposed revision; and may also request, in writing, that the Division hold an Informal Conference concerning the application. Cumberland River Coal Company, P. O. Drawer 109 Appalachia, Virginia 24216 is applying to the Virginia Division of Mined Land Reclamation for Phase II bond release on Increments No. 2 and No. 6 of Permit No.1601486 located in Wise County approximately 2 Miles North of Dunbar, Virginia on Potcamp Fork. The post mining land use for this permit area is unmanaged forest. The northing and easting are approximately 3555000 and 10245000, respectively. The permit area consists of 1646.34 Pool Bonded acres. The Whitesburg, KY and Appalachia, Norton, and Flat Gap, VA USGS 7.5-minute topographic maps were used to describe the location of the permit area.

As provided by § 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $2,708,400.00 in the form of a Surety posted for this permit be reduced by $929,000.00. This bond release request on Increment No. 2 and No. 6 is based upon the acceptable growth of both grasses and tress within both Increment areas.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any Federal, State, or Local Government agency or authority may within 30 days of April 2, 2013 submit written comments or objections, concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation’s office in Big Stone Gap, Virginia.
