All that certain piece or parcel of land situate, lying and being in Wise County, Virginia, on Supulcher Branch below and near the Town of Glamorgan, Virginia, adjoining the Wise Terminal Railroad (now Interstate Railroad) right of way, the W.H. Dean heirs, and other and more particularly bounded and described. Beginning at a stake in the W. H. Dean Heirs’ line and the western line of the Wise Terminal Railroad right-of-way, and 40 feet from the center line of said right-of-way and at right angles therefrom; said beginning corner situate in a bearing and distance of N 66 47 W 51 feet from a chestnut and white oak stump on the west bank of a branch, corner of the W.F. Carter lot and the W.H. Dean Heirs’ land; thence from the beginning point and parallel with the right of way of Wise Terminal Railroad and 40 feet from the center of said railroad right of way, N 30 49 E 45 feet to a stake; thence N 28 37 E 43 feet to a stake; thence N 27 47 E 45 feet to a stake, corner to the W.F. Carter lot; thence leaving the railroad right of way line and running with one line of the W.F. Carter lot N 66 48 W 278 feet to a stake in the Eastern line of 15 feet wide alley; thence along the Eastern line of said alley S 63 W 167.5 feet to a stake in a line of the W.H. Dean Heirs’ land; and thence with said line S 66 47 E 370.7 feet to the beginning, containing one (1) acre, more or less.

Being the same property conveyed to William Baldwin and Sarah Baldwin by Deed dated March 26, 1979 and recorded in the Wise County Circuit Court Clerk’s Office in Deed Book 526, Page 584, reference to which Deed is hereby made.

A Decision Notice and Finding of No Significant Impact for the Hardwood Restoration Project on the Clinch Ranger District, George Washington and Jefferson National Forest was signed on June 7, 2013 by District Ranger Jorge Hersel. This Decision Notice will allow the sale of planted White Pine on approximately 100 acres in Compartments 2043, 2050, 2052 and 2076 in Wise and Lee Counties Virginia. Only individuals or organizations who submitted comments or otherwise expressed interest by the close of the specified comment period in March 2012 may appeal this project (36 CFR 215.13). A written appeal of this decision must be submitted within 45 days following the publication date of this legal notice in the Coalfield Progress. Pursuant to 36 CFR 218, District Ranger Jorge Hersel requests comments on the proposed project described below.

The Virginia Department of Transportation has requested a 0.139 acre Right of Way adjacent to State Route 630 in Wise County. This easement will be on the north side of State Route 630 where the road travels between corners 6 and 7 of federal tract 550a. This easement to widen the curve to improve the sight distance of drivers and radius of travel on the road. Through VDOT engineer evaluation this curve does not meet modern standards for the amount of traffic this road receives. This project is needed to improve the safety of drivers on State Route 630.

Pursuant to 36 CFR 218, District Ranger Jorge Hersel requests comments on the proposed project listed above. The Clinch Ranger District is proposing management activities on 100 acres in Compartments 2047, 2049, 2050, and 2051 of the George Washington and Jefferson National Forest. The project analysis area is about 1,972 acres near the Flatwoods Job Corps Center in Wise County, Virginia, and lies in the drainage of Selcer Branch of Guest River, and Star Branch and Corder Branch of Little Stony Creek.

Paramont Coal Company Virginia, LLC is applying for bond release on Permit # 1601891, located in Wise County, 2 miles SW of Saint Paul, VA off Route 58 at Virginia City. This permit consists of 15.89 acres which are bonded under the Virginia Coal Surface Mining Reclamation Fund (Pool Bond) for $100,000.00 in the form of an insurance surety. As provided by 4 VAC 25-130.801.17 of the Virginia Coal Surface Mining Reclamation Regulations, the applicant is requesting a Phase III bond release on Increment # 2 & Increment # 4 and a Phase II bond reduction on Increment # 5.

This bond release request is based on the completion of five full growing seasons, implementation of the postmining land uses and the following reclamation:

1. Backfilling, regrading, top-soiling and re-vegetation of disturbed areas.

2. The postmining land uses were implemented in Increment # 2 on 9/15/1998, Increment # 4 on 3/15/2008 and Increment # 5 on 7/17/2009.

3. Increment # 4 contains approximately 570 trees per acre, with 90% ground cover.

4. The post-mining land uses of public road and unmanaged forest have been successfully established.

Any person with a valid legal interest which might be adversely affected by this proposal; or an officer or head of any federal, state or local government agency or authority may within 30 days of June 28, 2013 submit written comments or objections concerning this bond release, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation's office in Big Stone Gap, Virginia.
