Maggard Branch Coal, LLC of 5703 Crutchfield Drive, Norton, Virginia 24273 is applying for NPDES Renewal only of PERMIT NO., 1402032/0082032. The mine site is located in Wise County Virginia, approximately 2 miles northwest of Imboden, Virginia off State Route 68. The northing and easting coordinates are 3516430.61 and 10215953.01 respectively on the Appalachian U. S. G. S. 7.5 minute quadrangle map. All surface drainage will pass through approved sediment control structures and then be discharged into Mud Lick Creek of Callahan Creek of Powell River. All ponds and NPDES points have been eliminated.

A copy of the renewal application material is available for public inspection and comment at the office of the Circuit Court Clerk, Wise County Courthouse in Wise, VA. Red River Coal Company, Inc. is applying to the Virginia Division of Mined Land Reclamation for Phase III bond release on Increment No.6 consisting of 38.44 acres and the post mining land use of unmanaged forest has been met. Permit Number 1101401 is located:

The permit area is located approximately 6.5 miles southwest of Pound, near Flat Gap, off Route 620. The proposed bond release area is located near South Fork of Pound River and Rat Creek and is on the Flat Gap USGS 7.5 Minute Topographic Quadrangle Map.

This permit consists of 792.75 acres, which are bonded for $1,029,000.00 in form of insurance surety. As provided by §4 VAC 25-130-800.40 and §4 VAC 25-130-801.170 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting a Phase III bond release of $45,600.00 on Increment No.6 consisting of 38.44 acres and the post mining land use of unmanaged forest has been met. Backfilling, regrading, seeding and tree planting was last performed on October 2001.

A copy of the bond reduction materials is available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the bond release and reduction proposal, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of August 23, 2013 submit written comments or objections to the Division of Mined Land Reclamation concerning the bond release and/or reduction; and may also request, in writing, that the Division hold an Informal Conference concerning the application.
