TO WHOM IT MAY CONCERN:

The Department of Mines, Minerals, and Energy, Division of Mined Land Reclamation, of the Commonwealth of Virginia, pursuant to the authority granted in the Virginia Coal Surface Mining Control and Reclamation Act of 1979 (Chapter 19, Article 4, Section 45.1-260 et seq.,) with funding provided by the 2011 Consolidated Grant, has determined and found that:

Land located along Campus Road off Rock Bar Road and along Adwell Road and Cormorant Road in Wise County, Virginia, has been adversely affected by past coal mining practices, to wit:

1. Property owners, both known and unknown, are hereby notified of the Division’s intention to reclaim the area adversely affected by past coal mining practices. The purpose of this Notice is to provide notice to any landowners, heirs, assigns and devisees who may be affected by the proposed reclamation and who have not been identified and who have not granted written consent.

2. The public health, safety and property is endangered by: localized flooding from abandoned surface mines.

3. The proposed action consists of:

Regrading surface mined land and installing drainage structures to establish positive drainage patterns away from residents

Reestablishing vegetation on all areas disturbed by this work

Utilizing standard erosion and sediment control measures throughout all phases of this work

4. Known property owner(s) in the area of the proposed reclamation are:

PUBLIC NOTICE

Notice is hereby given that The Banner Company of 110 Sprint Drive, Blountville, TN intends to conduct blasting activities on Surface Mine Permit/Application No. 1101763. Proposed mine operation will be located near the headwaters of Coon Branch and along the ridgeline between the watersheds of Neece Creek and Coon Branch of McClure River, off state route 652.

All blasting shall be conducted in accordance with the following schedules of dates and times, unless emergency conditions dictate unscheduled detonation. Blasting will be conducted during daylight hours, between sunrise and sunset, six (6) days a week, Monday through Saturday. This notice shall be in effect for 12 months from date of publication.

Public access to the area prior to blasting will be controlled by barricading all access roads. The pre-blast audible warning shall consist of three minutes prior to blast. A warning sign audible to a range of one-half mile from blast site will be given - three long signals of five seconds duration with five seconds between each signal indicate clear the area. After the area has been cleared, two (2) long signals, indicate ready to fire, wait two (2) minutes, one (1) long signal, fire. The "All Clear" signal shall consist of three short signals on the air horn/siren.

Paramont Coal Company Virginia, LLC of 5703 Crutchfield Drive, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation (VDMLR), by Application 1008447, for a renewal to its National Pollution Discharge Elimination System (NPDES) Permit 0082008.

The South Fork Surface Mine is located in Wise County, approximately 1.9 miles southwest of Pound, off State Route 671, on South Fork of the Pound River. The permit area is approximately 253.18 acres with a State Plane Northing of 3,860,000 and State Plane Easting of 10,278,000 on the Flat Gap, Virginia USGS 7.5 minute topographic quadrangle. Drainage and wastewater resulting from the operations will pass through approved sediment control structures prior to being discharged into South Fork of the Pound River.

Copies of the draft NPDES permit and fact sheet are available for public inspection and comment at VDMLR’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the proposed operation, or any Officer or Head of any Federal, State, or Local Government agency or authority may within 30 days of December 14, 2012 submit written comments or objections to VDMLR concerning the proposed revision; and may also request, in writing, that VDMLR hold an informal conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130-773.13(c) of the Virginia Coal Surface Mining Reclamation Regulations.

Cumberland River Coal Company, P. O. Drawer 109 Appalachia, Virginia 24216 is applying to the Virginia Division of Mined Land Reclamation for Phase II bond release on Increments No. 2 and No. 6 of Permit No.1601486 located in Wise County approximately 2 Miles North of Dunbar, Virginia on Potcamp Fork. The post mining land use for this permit area is unmanaged forest. The northing and easting are approximately 3555000 and 10245000, respectively. The permit area consists of 1646.34 Pool Bonded acres. The Whitesburg, KY and Appalachia, Norton, and Flat Gap, VA USGS 7.5-minute topographic maps were used to describe the location of the permit area.

As provided by § 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $2,708,400.00 in the form of a Surety posted for this permit be reduced by $924,050. This bond release request on Increment No. 2 and No. 6 is based upon the acceptable growth of both grasses and tress within both Increment areas.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any Federal, State, or Local Government agency or authority may within 30 days of January 11, 2013 submit written comments or objections, concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation’s office in Big Stone Gap, Virginia.
