In execution of a corrected deed of trust, from RICK D. SUTHERLAND, aka Ricky Dean Sutherland and DAINA L. SUTHERLAND, aka Diana Lynn Sutherland, dated July 6, 2010, in the original principal amount of $85,808.73, recorded in the Clerk’s Office of the County of Dickenson, Virginia, in Deed Book 478, at Page 659, (Seth E. Twery, P.C. having been appointed Substitute Trustee under instrument of record in said Clerk’s Office in Deed Book 501, at page 514), due to default in payment of the debt secured, the undersigned Substitute Trustee will offer for sale at public auction in front of the Courthouse for the Circuit Court of Dickenson County, Virginia on the 14th day of January, 2013, at 11:30 a.m.,that certain tract of real estate known as 950 Sutherland Ridge, Clinchco, VA 24226 situated in Dickenson County, Virginia, being more particularly described as follows:

Situate, lying and being on the waters of McClure Creek in Dickenson County, Virginia, and being more particularly bounded and described as follows:

BEGINNING at an iron pin (new) in the sideline of Sutherland Ridge Road, and a 40 foot right of way; thence with the sideline of the 40 foot right of way and the property herein conveyed the following calls and distances: S. 34 degrees, 11' 20" W. 98.44 feet to an iron pin (new); S. 25 degrees, 26' 50" W. 89.21 feet to an iron pin (new); S. 21 degrees, 37' 40" W. 51.77 feet; S. 18 degrees, 41' 30" W. 32.65 feet, to an iron pin (new); S. 16 degrees, 23' 50" W. 28.55 feet to an iron pin (new); S. 22 degrees 42' 00" W. 41.03 feet to an iron pin (new), corner for the remaining property of Rick and Diana Sutherland, (DB 475, page 710) and the 40 foot right of way; thence with the new divisional line of Sutherland, N. 32 degrees 12' 50" W. 312.74 feet to an iron pin (new); thence N. 3 degrees, 45' 20" W. 382.46 feet to an iron pin (new), corner for Clinchfield Coal Company Joshua Pressley 940.59 acre tract; thence with the divisional line of Clinchfield, S. 44 degrees, 54' 20" E. 480.00 feet to the point of BEGINNING, containing 2.34 acres more or less, as shown on survey by Larry Culbertson, dated May 19, 2010, entitled “SURVEY FOR RICK AND DIANA SUTHERLAND”

Paramont Coal Company Virginia, LLC, 5703 Crutchfield Dr, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation (VDMLR) for a Revision of Permit No. 1101955 and NPDES Number 0081955 in order to add approximately 279.78 acres to the existing coal surface mining and reclamation operations and to add three ponds, (17, 18 & 19) and two NPDES points, (017 and 018) at the following location:

The additional mining area is located in Buchanan and Dickenson Counties approximately south of Duty. The existing and proposed permit area is at latitude 38º 44’ 13” and longitude 84º 30’ 17” on the Duty 7.5’ USGS Quadrangle. The permit area being added is situated along the drainage divide of Left Fork of Cane Creek and Three Forks Branch. Surface drainage will be passed through sediment control structures prior to being discharge into receiving streams. Surface drainage from the proposed permit area will enter Cane Creek, Left Fork, Indian Creek and Three Fork Branch.

A copy of the application materials will be available for inspection and public comment at the Circuit Court Clerk’s Office at the Buchanan County Courthouse, Grundy, Virginia and the Dickenson County Courthouse, Clintwood, Virginia. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at VDMLR’s Big Stone Gap office.

Any person whose interests are or may be adversely affected by the proposed operation, or any officer or head of any Federal, State, or Local Government agency or authority may within 30 days of January 16, 2013, submit written comments or objections, concerning the proposed operation, and may also request in writing, that VDMLR hold an informal conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130-773.13(c) of VDMLR’S Regulations.
