In execution of a Credit Line Deed of Trust dated September 29, 2010, in the original amount of $141,889.20, recorded as Instrument Number 20103066 in the Clerk’s Office for the Circuit Court of Wise County, Virginia, the undersigned Trustee (hereinafter “Trustee”) will, on Thursday, January 17, 2013, at 10:30 a.m., at the front doors of the Wise County Courthouse, 206 East Main Street, Wise, Virginia, offer for sale at public auction to the highest bidder the following property with improvements thereon:

All that certain tract or parcel of land situate in the Town of Pound, Wise County, Virginia, more particularly bounded and described as follows, to-wit:

BEGINNING at a stake on the north corner of the H. C. Boggs by Deed dated June 25, 1986 and recorded in the Wise County Circuit Court Clerk’s Office in Deed Book 627, Page 236, and by Deed dated June 13, 1986 and recorded in the Wise County Circuit Court Clerk’s Office in Deed Book 627, Page 230. This conveyance is made subject to all prior recorded conditions, restrictions, reservations, easements and conveyances affecting the property hereby conveyed.

Deposit of $5,000.00 cash or check drawn upon certified funds (no personal or cashier’s checks drawn upon uncertified funds accepted without prior Trustee approval) for the bid shall be required to qualify as a bidder before the sale, or 10% of the bid price, whichever is lower, except from the Noteholder. PUBLIC NOTICE

Notice is hereby given that The Banner Company of 110 Sprint Drive, Blountville, TN intends to conduct blasting activities on Surface Mine Permit/Application No. 1101763. Proposed mine operation will be located near the headwaters of Coon Branch and along the ridgeline between the watersheds of Neece Creek and Coon Branch of McClure River, off state route 652.

All blasting shall be conducted in accordance with the following schedules of dates and times, unless emergency conditions dictate unscheduled detonation. Blasting will be conducted during daylight hours, between sunrise and sunset, six (6) days a week, Monday through Saturday. This notice shall be in effect for 12 months from date of publication.

Public access to the area prior to blasting will be controlled by barricading all access roads. The pre-blast audible warning shall consist of three minutes prior to blast. A warning sign audible to a range of one-half mile from blast site will be given - three long signals of five seconds duration with five seconds between each signal indicate clear the area. After the area has been cleared, two (2) long signals, indicate ready to fire, wait two (2) minutes, one (1) long signal, fire. The "All Clear" signal shall consist of three short signals on the air horn/siren.

Cumberland River Coal Company, P. O. Drawer 109 Appalachia, Virginia 24216 is applying to the Virginia Division of Mined Land Reclamation for Phase II bond release on Increments No. 2 and No. 6 of Permit No.1601486 located in Wise County approximately 2 Miles North of Dunbar, Virginia on Potcamp Fork. The post mining land use for this permit area is unmanaged forest. The northing and easting are approximately 3555000 and 10245000, respectively. The permit area consists of 1646.34 Pool Bonded acres. The Whitesburg, KY and Appalachia, Norton, and Flat Gap, VA USGS 7.5-minute topographic maps were used to describe the location of the permit area.

As provided by § 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $2,708,400.00 in the form of a Surety posted for this permit be reduced by $924,050. This bond release request on Increment No. 2 and No. 6 is based upon the acceptable growth of both grasses and tress within both Increment areas.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any Federal, State, or Local Government agency or authority may within 30 days of January 11, 2013 submit written comments or objections, concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation’s office in Big Stone Gap, Virginia.

BLASTING SCHEDULE

In compliance with Section 4 VAC 25-130-816.64 of the Virginia Coal Surface Mining Reclamation Regulations, notice is hereby given that Paramont Coal Company Virginia, LLC, having been issued Surface Mine Permit Number 1101849, will be conducting blasting operations on the permit area. The permit area is located approximately 2.5 miles east of Pound, Virginia off State Routes 83, 638 and 361 in Wise and Dickenson Counties. Blasting will be in accordance with all applicable State and Federal laws and will commence according to the following schedule of dates and times, as approved by the regulatory authority:

Access to the blasting area will be controlled to prevent unauthorized entry at least ten (10) minutes prior to any blasting event. A warning signal, indicated by three long blasts on an air horn, will be sounded to clear the area. Then another warning signal indicated by two long blasts on an air horn, two minute delay, then one long horn blast prior to the blasting and an all-clear signal indicted by three short blasts will be audible within a range of one-half mile from the point of the blast in accordance with applicable State and Federal laws.

Also, blasting will not be conducted at times other than those announced except in emergency situations where rain, lightning, atmospheric conditions, or operator or public safety requires unscheduled detonation as approved by the regulatory authority.

Anyone owning a dwelling or structure located within one-half mile of the permit boundary desiring to have a pre-blast survey conducted may notify the Division of Mined Land Reclamation, P.O. Drawer 900, Big Stone Gap, VA 24219, phone (276) 523-8190. The request must be made in writing and should include a daytime telephone number.
