In compliance with Section V816.64 of Virginia Coal Surface Mining Regulations, notice is hereby given the A&G Coal Corporation, P.O. Box 1010, Wise, Virginia 24293, having been issued Surface Mine Permit 1101991, located approximately 3.9 miles northeast of Appalachia in Wise County.

Blasting will be in accordance with all applicable state and federal laws and will commence according to the following schedule of dates and times as approved by the regulatory authority.

Access to the blasting area will be controlled to prevent unauthorized entry at least ten (10) minutes prior to any blasting event. A warning signal indicated by 3 long blasts on an air horn will be sounded to clear the area. Then another warning signal indicated by two long blasts on an air horn, two-minute delay, then one long horn blast prior to the blasting and an all-clear signal indicated by three short blasts of longer horn will be audible within a range on one-half mile from the point of the blast in accordance with applicable State and Federal laws.

Blasting will not be conducted at times other that those announced except in emergency situations where rain, lightning, atmospheric conditions, or operator or public safety requires unscheduled detonation as approved by the Division of Mined Land Reclamation.

Red River Coal Company, Inc., P.O. Box 668, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation for renewal of CSMO Permit Number 1100084/NPDES Permit Number 0080084 in order to continue the operations at the following location:

Approximately nine miles north of Norton in Wise County, near the headwaters of Guest River. The permit area can be reached by turning west off Rt. 620 approximately 0.4 mile north of the intersection of Rt. 620 and 701. The permit area covers 162.45 acres on the eastern slope of Indian Mountain between Critical Fork and Roberts Branch.

The permit area is located on the Flat Gap, VA-KY USGS quadrangle map.

The proposed operation will come within 100 feet of State Route 620.

Drainage and wastewater resulting from the mining operation will pass through approved sediment control structures and be discharged to Critical Fork and Guest River.

A copy of the application materials is available for public inspection and comment at the Wise County Circuit Court Clerk’s Office. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. OSM, in collaboration with each state to the extent possible, develops a state-specific Performance Agreement/Evaluation Plan tailored to the unique conditions of each state program. Performance Agreements/Evaluation Plans between OSM and the states establish how oversight is conducted during each evaluation year. OSM’s Knoxville Field Office/Big Stone Gap Area Office will soon begin drafting the annual Performance Agreement/Evaluation Plan with Virginia for OSM’s Evaluation Year 2014 that begins on July 1, 2013. As a part of that process, we welcome input from interested parties to comment on oversight and provide suggestions for potential oversight evaluation topics, including the opportunity for discussion with our office. For us to consider your comments and suggestions, we must receive them by March 30, 2013.

Paramont Coal Company Virginia, LLC is applying for bond release on Permit No. 1201866 located in Wise County, 1 miles W of Coeburn, VA, off Route 813 on Guest River .This permit consists of 5.36 acres. As provided by 4 VAC 25-130.800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the applicant is requesting that the current total bond amount of $16,000 in the form of an insurance surety posted for this permit be released.

This bond release request is based on the following Phase III reclamation:

1. Backfilling, regrading, topsoiling and hydroseeding of the disturbed area.

2. Final hydroseeding was performed on 06/21/07 and trees planted 03/11/08.

3. All disturbances have been revegetated.

The post-mining land use is unmanaged forest.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any federal, state or local government agency or authority, may within 30 days of March 22, 2013 submit written comments or objections concerning this bond release, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference.
