Red River Coal Company, Inc., P.O. Box 668, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation for renewal of CSMO Permit Number 1100084/NPDES Permit Number 0080084 in order to continue the operations at the following location:

Approximately nine miles north of Norton in Wise County, near the headwaters of Guest River. The permit area can be reached by turning west off Rt. 620 approximately 0.4 mile north of the intersection of Rt. 620 and 701. The permit area covers 162.45 acres on the eastern slope of Indian Mountain between Critical Fork and Roberts Branch.

The permit area is located on the Flat Gap, VA-KY USGS quadrangle map.

The proposed operation will come within 100 feet of State Route 620.

Drainage and wastewater resulting from the mining operation will pass through approved sediment control structures and be discharged to Critical Fork and Guest River.

A copy of the application materials is available for public inspection and comment at the Wise County Circuit Court Clerk’s Office. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. SURFACE MINING

BLASTING SCHEDULE

In compliance with Section V816.64 of Virginia Coal Surface Mining Regulations, notice is hereby given the A&G Coal Corporation, P.O. Box 1010, Wise, Virginia 24293, having been issued Surface Mine Permit 1102028, located approximately 1.7 miles northeast of lower Exeter and Exeter Communities in Wise County, will be conducting blasting on the area covered by the permit. Blasting will be in accordance with all applicable state and federal laws and will commence according to the following schedule of dates and times as approved by the regulatory authority.

February 24, 2014

Monday-Saturday

8am-Sunset

Access to the blasting area will be conducted to prevent unauthorized entry at least 10 minutes prior to any blasting event. A warning signal indicated by 3 long single blasts of loader horn – clear all persons; 2 long single blasts – wait 2 minutes; 1 long single blast – shoot. An all-clear signal indicated by 3 short single blasts of longer horn – all clear will be audible within a range of one-half mile from the point of blast in accordance with applicable state and federal laws. Blasting will not be conducted at times other than those announced except in unavoidable hazardous situations where operator or public safety required unscheduled detonation as approved by the Division of Mined Land Reclamation.

This schedule will be republished and redistributed at least every 12 months by mail to local governments and public utilities and by mail or delivered to each residence within one-half mile of the permit area described in the schedule. In addition to residents, each person working within one-half mile of the permit area shall be notified of the meaning of the blasting signals.

As provided by 4 VAC 25-130.800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the applicant is requesting that the current total bond amount of $16,000 in the form of an insurance surety posted for this permit be released.

This bond release request is based on the following Phase III reclamation:

1. Backfilling, regrading, topsoiling and hydroseeding of the disturbed area.

2. Final hydroseeding was performed on 06/21/07 and trees planted 03/11/08.

3. All disturbances have been revegetated.

The post-mining land use is unmanaged forest.
