In execution of that certain deed of trust in the original principal amount of $54,000.00 dated August 9, 2007 and recorded among the land records of Wise County, Virginia, as Instrument Number 200705170 as amended by an instrument appointing the undersigned as Substituted Trustee, default having been made in the payment of the indebtedness thereby secured and having been requested to do so by the holder of the note evidencing the said indebtedness, the undersigned Substituted Trustee will offer for sale at public auction in front of the Wise Circuit Court, 206 East Main Street, Wise, Virginia, on:

All that certain tract, piece or parcel of land, together with all improvements thereon, situated, lying and being in Wise County, Virginia, more particularly bounded and described as follows, to-wit:

Being Lot No. 7 of Block No. 1 of the Stallard Real Estate Company Inc. addition to Appalachia as recorded in Plat Book 32 Page 164 situated near high school in the town of Appalachia, Wise County, Virginia, and being further described as follows, to wit:

Beginning at an iron pin in the western R-O-W line of Lee Street, a common corner of Lot No. 6; thence with said Lot No. 6 S 81 degrees 05` 00" W 129.04` to an iron pin in the Eastern edge of 12` wide alley; thence with same N 01 degrees 25` 00" E 50.20` to an iron pin, , a common corner to Lot No. 8; thence with said Lot N 81 degrees 05` 00" E 129.93` to an iron pin in the Western R-O-W line of aforesaid Lee Street; thence with the same S 02 degrees 25` 00" W 50.37 to the Beginning, having the physical address of 212 Lee Street, Appalachia Virginia 24216.

TERMS OF SALE: Cash or certified funds. A non-refundable deposit of ten percent (10%) of the successful bid price, payable in cash or by certified or cashier's check to the undersigned will be required of the successful bidder at time of sale. Terms of sale to be complied with within 14 days from date of sale or deposit will be forfeit and property will be resold at costs of defaulting purchaser. All real estate taxes to be adjusted as of date of sale. Seller shall not be responsible for any costs incurred by the purchaser in connection with their purchase or settlement, including, without limitation, state and local recording fees, title insurance or research, or any other costs of purchaser's acquisition. The property and the improvements thereon will be sold as is, without representations or warranties of any kind. The sale is subject to all other liens, encumbrances, conditions, easements and restrictions, if any, superior to the aforesaid deed of trust and lawfully affecting the property. Trustee shall have no duty to obtain possession for purchaser. All risks of casualty pass to successful bidder at conclusion of bidding. Sale is subject to post-sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower(s) entered into any repayment agreement, reinstated or paid off the loan prior to the sale. APPROVAL OF A CATEGORICAL EXCLUSION FROM

AN ENVIRONMENTAL ASSESSMENT FOR A PROJECT

FUNDED THROUGH THE

VIRGINIA WATER SUPPLY REVOLVING FUND

The Virginia Department of Health has under consideration a request for a Categorical Exclusion from an Environmental Assessment for a

waterworks project proposed to be funded through the Virginia Water Supply Revolving Fund. The applicant is City of Norton.

Project Description: The project is located in the City of Norton, Virginia and surrounding areas served by the City of Norton public waterworks. Approximately 11,410 linear feet of 8, 6, 4, and 2-inch diameter waterline will be replaced in the general areas of 10th Street, 11th Street, and Dorchester Road, 2,000 radio read meters will be replaced system-wide, and generators will be added to the existing Hoot Owl Hollow, IDA, and Hawthrone pump stations. All waterline and meter replacement will occur in the area of existing waterlines which are mainly located within the limits of existing waterline easements, road right-of-ways, and/or previously disturbed area. Generators will be installed at existing pump stations.

The applicant feels that the project meets the following exclusion categories established by the Department: Waterline replacement/rehabilitation to correct exfiltration water loss problems or problems associated with inadequate water pressure. Replacement of existing equipment or structures at their present location. Minor

extensions of waterlines, which will be located within the road right-of-ways or otherwise previously, disturbed areas.

Documentation supporting this request includes: April 12, 2013 Categorical Exclusion request prepared by The Lane Group and May 13,

2013 FCAP Environmental Review site visit documentation.

Prior to implementing construction, the applicant will obtain all applicable permits and approvals. On the basis of a review of the request and support documentation, the Virginia Department of Health proposes to approve the request.

Persons may comment in writing to the Department on the proposed approval of the Categorical Exclusion within 30 days from the first publication date. Comments shall include the name, address, and telephone number of the writer and shall contain a complete, concise statement of the factual basis for the comments. Only those comments received within this period will be considered by the Department. Following the comment period, the Department will make its determination regarding the approval.
