Maggard Branch Coal, LLC of 5703 Crutchfield Drive, Norton, Virginia 24273 is applying for NPDES Renewal only of PERMIT NO., 1201828/0081828. The permit area is situated in Wise County approximately 1.5 mile northwest of Roda, Virginia, off State Route 685, in the watershed of Mud Lick Creek of Callahan Creek of Powell River. The proposed mine site is located on the Appalachian and Whitesburg U. S. G. S. 7.5 minute quadrangle maps with central coordinates at latitude 36∞ 59' 39" and longitude 82∞ 49' 22". All surface drainage will pass through approved sediment control structures and then be discharged into Mud Lick Creek of Callahan Creek of Powell River. All ponds and NPDES points have been eliminated.

A copy of the renewal application material is available for public inspection and comment at the office of the Circuit Court Clerk, Wise County Courthouse in Wise, VA. A copy of the draft NPDES permit and fact sheet is available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the renewal application, or Officer or Head of any Federal, State or local Government agency or authority may within 30 days of June 14, 2013 submit written comments or objections to the Division of Mined Land Reclamation concerning the renewal application; and may also request, in writing, that the Division hold an Informal Conference concerning the application. A request for an informal conference shall follow the requirements of 4VAC 25-130-773.13c of the Virginia Coal Surface Mining Reclamation Regulations.

FOR PROPOSALS

The Wise County Board of Supervisors will receive proposals for auctioneer services for vehicles and trailers. These items are surplus property located at the Wise County Landfill at Blackwood. Proposals should at a minimum provide information on personnel, experience, services and provide a fee structure for those services. A complete detail of those requirements can be found on the Wise County website.

Proposals will be accepted until 4:00 pm on June 21, 2013. All questions regarding proposals should be directed to the Wise County Finance Administrator.

Paramont Coal Company Virginia, LLC is applying for bond release on Permit # 1601891, located in Wise County, 2 miles SW of Saint Paul, VA off Route 58 at Virginia City. This permit consists of 15.89 acres which are bonded under the Virginia Coal Surface Mining Reclamation Fund (Pool Bond) for $100,000.00 in the form of an insurance surety. As provided by 4 VAC 25-130.801.17 of the Virginia Coal Surface Mining Reclamation Regulations, the applicant is requesting a Phase III bond release on Increment # 2 & Increment # 4 and a Phase II bond reduction on Increment # 5.

This bond release request is based on the completion of five full growing seasons, implementation of the postmining land uses and the following reclamation:

1. Backfilling, regrading, top-soiling and re-vegetation of disturbed areas.

2. The postmining land uses were implemented in Increment # 2 on 9/15/1998, Increment # 4 on 3/15/2008 and Increment # 5 on 7/17/2009.

3. Increment # 4 contains approximately 570 trees per acre, with 90% ground cover.

4. The post-mining land uses of public road and unmanaged forest have been successfully established.

Any person with a valid legal interest which might be adversely affected by this proposal; or an officer or head of any federal, state or local government agency or authority may within 30 days of June 28, 2013 submit written comments or objections concerning this bond release, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation's office in Big Stone Gap, Virginia.
