Now comes your petitioner, The Wise County Department of Social Services, and moves this honorable court for an order of publication in the above referenced matter. This suit is for a permanency planning hearing and the termination of parental rights of the father of a child known as TAMERA BURNS.

And, it appearing by affidavit filed according to law that the identity of the father of TAMERA BURNS is unknown and the location of the father of TAMERA BURNS is unknown, it is therefore ORDERED that the father of TAMERA BURNS or anyone else with an interest in the termination of parental rights of TAMERA BURNS appear on or before the 19th day of November, 2013 at 9:00 AM in the Clerk’s Office of this Court and do what is necessary to protect his/her interests.

NOTICE OF TRUSTEE’S SALE

In execution of a Deed of Trust dated 04-26-2005, recorded as Instrument No. 200501725, in the Clerk’s Office of the Circuit Court of the County of Wise, Virginia, the undersigned Trustee, will on October 11, 2013, at 9:15 a.m., at the front doors of the Courthouse of Wise County, Virginia, offer for sale at public auction to the highest bidder the following property:

All that certain tract, piece or parcel of land situate, lying and being in Wise County, Virginia, about one-half mile east of the Town of Coeburn, on Little Toms Creek, and designated as Lot No. 2, and more particularly described as follows, to-wit:

BEGINNING at a point in the South edge of State Highway, a corner to Lot No. 1; thence with said Highway N. 78 W. 54 feet to a point, a corner to County lot; thence with line of same S. 5 W. 63.5 feet to a point in the Norfolk and Western Railway right of way and with same 75 feet to a stake, a corner to Lot No. 1; thence with Lot No. 1, N. 10 31 W. 52 feet to a point of the Beginning.

Being the same property Tim Gardner and April Gardner, his wife, acquired by deed dated the 15th day of September, 2005, from Tim Gardner of record in the Circuit Court Clerk’s Office of Wise County, Virginia, as Instrument No. 200504361, and by deed dated the 26th day of April, 2005, from Edith Richardson of record in said Clerk’s Office as Instrument No. 200501724.

There is also GRANTED to the Grantee the use of any and all easements, right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantor, whether by express grant, prescriptive use or otherwise, and which are appurtenant to and part of the use and enjoyment of this particular tract or land.

There is also CONVEYED by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.

This conveyance is made SUBJECT to all prior recorded conditions, restrictions, reservations, easements and conveyances affecting the property hereby conveyed.

This sale is subject to all restrictions, rights-of-way, conditions, easements, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust.

Deposit of 10% of the purchase price, by cash or certified check shall be required of the highest bidder, except from the Noteholder. Deposit, without interest, is applied to the purchase price at settlement. Settlement will be held on or before 15 days after sale, but may be extended in the discretion of the Trustee. Upon purchaser’s default, the deposit shall be forfeited and the property shall be resold at the risk and costs of the defaulting purchaser. In the event the Trustee cannot convey to the purchaser marketable title, in the Trustee’s sole discretion, the sale may be rescinded and the purchaser’s sole remedy shall be the refund of the deposit.

The balance of the purchase price shall be in cash or its equivalent. Settlement shall be at the office of the trustee or other mutually agreed location. The property and any improvements thereon shall be sold in “as is” condition without any warranties. The successful bidder shall assume all loss or damage to the property from and after the time of the sale. Purchaser shall be responsible for all costs of the conveyance, which shall be by special warranty, including but not limited to the preparation of the deed and the grantor’s tax. The sale is subject to such additional terms as the Trustee may announce at the time of sale. The purchaser will be required to sign a memorandum of sale incorporating all the terms of the sale.

Written notice of this Trustee’s Sale has been sent to the owners by certified mail in strict compliance with Section 55-59.1 of the Virginia Code.

In execution of a Deed of Trust dated 06-02-2006, recorded as Instrument No. 200602489, in the Clerk’s Office of the Circuit Court of the County of Wise, Virginia, the undersigned Trustee, will on October 11, 2013, at 9:00 a.m., at the front doors of the Courthouse of Wise County, Virginia, offer for sale at public auction to the highest bidder the following property:

All that certain tract or parcel of land situate, lying and being in the Town of Wise, Wise County, Virginia, and being more particularly bounded and described as follows, to-wit:

BEGINNING at an iron pin on the line of the property belonging to the Wise-Norton Post of Veterans of Foreign Wars, which said pin is 20 feet northeast from a house; thence S 67 26 W 324.01 feet to an iron pin; thence S 36 45 W 1027.78 feet to a stake in a road, witnessed by a ten inch locust 27.95 feet, N 15 00 W therefrom; thence S 68 39 E 806.29 feet to a chestnut oak on a cliff witnessed by two chestnut stumps to the East 2 feet; thence N 0 53 E 518.98 feet to two locusts in a corner of an orchard; thence N 56 52 E 288.00 feet to an iron pin in the fence line; thence N 8 39 W 574.50 feet to the BEGINNING, containing fourteen and six one-hundredths (14.06) acres, more or less, but sold by the boundary and not by the acre.

Being that same property conveyed unto Radio Wise, Incorporated, by a deed dated May 30, 1956, from Blanfox Radio Company, Incorporated, which said deed is recorded in Deed Book 331, Page 154, in the Clerk’s Office for Wise County, Virginia, reference to which said deed is hereby made.

There is further granted and conveyed an easement, but not exclusively, for a right of way for ingress to and egress from said tract or parcel of land, such right of way to be 30 feet in width and to parallel and adjoin the V.F.W. property, the Etta Lawson property and the Elmer Adams property, and to run from the northern line on the property hereby conveyed along and adjoining the V.F.W. property, the Etta Lawson property, and the Elmer Adams property to the point where the Adams, Lawson and Robinson properties corner, such right of way to be thirty (30) feet in width, including the present twenty (20) foot roadway.

There is also granted unto grantees all right, title and interest in and to the forty (40) foot right of way mentioned and described in said deed of April 19, 1956, and the said parties of the second part do hereby assume any obligations upon the said party of the first part with regard to the establishment of said right of way as contained in said deed of April 19, 1956, reference to which is hereby made.

EXCEPTING and RESERVING, the following parcels of land previously sold and conveyed from the aforesaid parcels:

October 7, 1986, in Deed Book 723, Page 748, Radio-Wise, Inc., to Roy L. Thacker and Mary Thacker, 0.0382 acres.

Cumberland River Coal Company, P. O. Drawer 109 Appalachia Virginia 24216 is applying to the Virginia Division of Mined Land Reclamation for the renewal of the above captioned permits. The permit is located Wise County approximately 2 Miles North of Dunbar, Virginia on Potcamp Fork. The northing and easting are approximately 3555000 and 10245000, respectively. The permit area consists of 1646.34 pool bonded acres. The Whitesburg, KY and Appalachia, Norton, and Flat Gap, VA USGS 7.5-minute topographic maps were used to describe the location to the permit area.

Drainage and wastewater from the mining operation is being controlled by approved sediment control structures and then discharges into Potcamp Fork and Roaring Fork.

A copy of the renewal materials will be available for inspection and public comment at the Circuit Court Clerk’s Office at Wise County Courthouse at Wise, Virginia. Any person whose interests are or may be adversely affected by the proposed operation, or any officer or head of any Federal, State, or Local Government agency or authority may within 30 days of October 11, 2013 submit written comments or objections, concerning the proposed operation, and may also request, in writing, that the Division of Mined Land Reclamation hold an informal conference.
