In execution of the Deed of Trust dated August 30, 2007, in the original principal amount of $80,102.00, recorded  in Deed Book 442, Page 352, in the Clerk's Office of the Circuit Court for the County of Dickenson, Virginia, default having occurred in the payment of the indebtedness thereby secured and at the request of the holder of the note, the undersigned, as Substitute Trustees,  either of whom may act, will sell at public auction at the front entrance of the Circuit Court for the County of Dickenson on October 17, 2013, at 9:30 a.m., the property located at the above address and generally described in said deed of trust by metes and bounds, containing 4.963 acres +/-, comprised of 3.68 acres as shown on deed recorded in Deed Book 397, page 610, and 1.281 acres as shown on a deed recorded in Deed Book 441, page 382 in the aforesaid Clerk's Office, County of Dickenson, Virginia.  

TERMS: CASH.  PROPERTY SOLD AS IS WITH SPECIAL WARRANTY OF TITLE.  A deposit of $ 7,000.00 or 10% of the successful bid amount (whichever is lower) will be required immediately of the successful bidder, in cash, cashier's check or certified funds only payable to "FIRST COLONY TRUSTEES, LLC, TRUSTEE", balance due within 15 days from date of sale.  No personal checks accepted.  Upon purchaser's default, the deposit shall be forfeited and the property resold at the risk and costs of the defaulting purchaser.  Sale is subject to post sale confirmation and audit of the status of the loan including, but not limited to, determination of whether the borrower filed for bankruptcy protection, entered into any repayment agreement, reinstated or paid off the loan prior to the sale.  In any such event, the sale shall be null and void, and the Purchaser's sole remedy, in law or equity, shall be the return of the deposit without interest.  Sale is subject to all prior liens, easements, restrictions, covenants, reservations and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises.  Real estate taxes will be adjusted to the date of sale.  All costs of conveyance, deed, examination of title, recording charges and grantor's tax will be at the cost of the purchaser.  All risks of casualty pass to the successful bidder.  Additional terms may be announced at the time of sale.  Time is of the essence.

Paramont Coal Company Virginia, LLC, 1274 Crutchfield Drive, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation (VDMLR) for a Phase 1 bond reduction on Bonding Increments I, III, IV, V and Phase III on Bonding Increment II for Permit No. 1101849 at the following location: Wise and Dickenson Counties, 2.5 miles east of Pound, Virginia on Georges Fork. This permit consists of 740.07 acres. As provided by 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $2,223,000 in the form of insurance surety posted for Phase I be reduced by $1,175,400 and Phase III to be released for $264,000.

This bond reduction request is based on the following Phase I reclamation:

Types of Reclamation Work Performed - the areas proposed for bond release/reduction have been reclaimed, revegetated, and the post-mining land uses have been achieved.

Appropriate Date(s) of Reclamation Work Performed – the reclamation work was completed June 2013.

Description of Reclamation Results Achieved The area proposed for post-mining land use of Commercial and Industrial –Manufacturing has been reclaimed and revegetated to meet the requirements of the mining permit and will be released to Dickenson County Industrial Development Authority upon release from the DMLR. The area proposed for a post-mining land use of Residential has an occupied dwelling. The area proposed for a post-mining land use Agricultural – Grazingland, Fish and Wildlife Habitat – Wetlands, Residential and Unmanaged Forest/Undeveloped Land has been revegetated with the appropriate ground control species and has been revegetated with trees.

Description of the Post-Mining Land Use - Agricultural – Grazingland, Fish and Wildlife Habitat – Wetlands, Residential and Unmanaged Forest/ Undeveloped Land.

This permit consists of 48.91 acres which are bonded under the Virginia Coal Surface Mining Reclamation Fund (Pool Bond). As provided by 4 VAC 25-130-801.17 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the total bond amount of $ 60,600 in the form of insurance surety currently posted for this permit be released.

This bond release request is based on completion of the extended period of responsibility (5 full years) for successful revegetation and the following reclamation: Successful revegetation of all areas, with seeding occurring until 2007. Postmining land uses of Agricultural, Grazing/ Hayland, and Industrial have been achieved. Results of the reclamation are very good.
