The object of this suit is to establish a copy of the Last Will and Testament of Allen J. “Big Al” Provance, Deceased, as his true and accurate will, thereby making g Stephanie Paige Meitz, Plaintiff, the sole beneficiary of his estate. The original will was formally executed on June 2, 2010, in the presence of three competent witnesses, who at the request of the testator, and in his presence, and in the presence of each other, subscribed the will at the foot of an attestation clause that set out the circumstances of execution, all of which was done at the BB&T Branch Office in Wise, Virginia, in strict conformity with the requirements of the statute in such case made and provided. The original will, duly executed as aforesaid, is now unable to be located among the deceased’s personal belongings. The Deceased’s heirs at law are his son, Dale Provance and his three daughters, Gayle Morris, Tammy Vogelgesang and Jennifer Riggen, all being defendants.

An affidavit having been made that the whereabouts and address of Jennifer Riggen are unknown; that Gayle Morris and Tammy Vogelgesang are nonresidents of the State of Virginia, and that their last known addresses are as indicated above; and that there may be other unknown heirs, devisees and successors in interest of the estate of the Deceased, and that their names, whereabouts, and addresses, if any, are unknown, it is hereby ORDERED that such persons appear on or before the 22nd day of November, 2013, and take such steps as may be necessary to protect their interests in this suit.

Is is further ORDERED that this Order be published once a week for four consecutive weeks in The Coalfield Progress, a newspaper having general circulation in Wise County, Virginia, of which the Deceased was a resident, and the Clerk of this Court is hereby ordered to do all things required of him by law.

TO ENACT AND

PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Town Council of the Town of Wise, Virginia will hold a public hearing on Tuesday, October 22, 2013 at 7:00 p.m. in Council Chambers of the Wise Municipal Building located at 501 West Main Street.  The purpose of the Public Hearing is to receive public comment on a proposed amendment of the Animal Control Ordinance to:

A.   Revise enforcement procedures to grant greater discretion to the responding officer to issue a notice or a summons of violation during the first instance of animals violating said Ordinance by:

1.   Creating a disturbance or creating a public nuisance

2.   Damaging, destroying, or disturbing the property of another person

3.   Running at large (with or without license tag)

4.   Being on public property by leash or otherwise while “in season”

5.  Running at  large during  an officially designated period of mandatory  confinement (quarantine)

And

B.   Eliminate separate provisions for second violations and instead designate all but first violations as further violations.

Include an assortment of self-propelled machines that transport people or cargo in the definition of “motor vehicle”.  This includes, but is not limited to, all terrain vehicles, antique motor vehicles, automobile or watercraft transporters, golf carts, mopeds, motorcycles, motorized skate board or foot scooters, dirt bikes, snow mobiles, and utility vehicles.

AND

Make operation of “motor vehicles” off-road creating excessive noise plainly audible across property boundaries a violation of the noise ordinance.

ISSUANCE OF A

STATEMENT OF ENVIRONMENTAL REVIEW FOR A PROJECT FUNDED THROUGH THE VIRGINIA CLEAN WATER REVOLVING LOAN FUND

The Department of Environmental Quality (DEQ) has issued a Statement of Environmental Review for the Route 72/Sheffield Acres Sewer Interceptor Project proposed to be funded through the Virginia Clean Water Revolving Loan Fund. The applicant is the Town of Coeburn.

The proposed project includes the installation of approximately 21,000 feet of 4-inch and 6-inch force main and related appurtenances beginning at the existing Sheffield Acres WWTP and terminating on Central Avenue in Coeburn. There are also two proposed pump stations, one at the Sheffield Acres WWTP site and the other near the Route 72 Guest River bridge. Final treatment will be at the CNW Regional WWTP.

A review of the Environmental Assessment conducted on this project indicates that either significant environmental impacts would not result from the proposed project or significant environmental impacts have been eliminated by making changes in the project. Consequently, a preliminary decision not to prepare an Environmental Impact Statement has been made.

Persons may comment in writing to the DEQ on the proposed decision within 30 days from the first publication date. Comments shall include the name, address, and telephone number of the writer, and shall contain a complete, concise statement of the factual basis for the comments. Only those comments received within this period will be considered by the DEQ.

All pertinent information, including the Statement of Environmental Review, the Environmental Assessment and the support documentation is on file and may be inspected and arrangements made for copying at:
