TERMS OF SALE: The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust to be announced at the time of sale. American Towers LLC is proposing to construct a 290-foot overall height self-support telecommunications tower at 8236 Indian Creek Rd, Wise, Wise County, VA, Tax Parcel ID 002710. 

The new tower structure will be lit with dual red/white, medium intensity flashing strobe with steady burning red side markers and the tower facility will include a 100’ by 100’ lease area and associated easements, along with a 30-ft buffer surrounding the lease area. American Towers LLC seeks comments from all interested persons on any potential significant impact the proposed action could have on the quality of the human environment pursuant to 47 C.F.R. Application for

Bond Reduction

Under Chapter 19, Title 45.1

Publication # 13HGC15

Paramont Coal Company Virginia, LLC is applying for bond reduction on Permit No. 1601871 located in Wise County, 4.4 miles NW of Saint Paul, VA off Route Nos. 58, 658, and 659 on Bull Run and Dry Fork. This permit consists of 1,200 acres which are bonded for $1,630,900.00 in the form of an insurance surety. As provided by 4 VAC 25-130.800.40 and 4 VAC 25-130.801.17 of the Virginia Coal Surface Mining Reclamation Regulations, the applicant is requesting a Phase I bond reduction on Increments # 2, 3, 4 and 5, and a Phase III bond release on Increment # 1 and 7. The applicant is requesting that the current bond amount be reduced by $1,242,700.

This bond reduction request is based on the completion of the implementation of the post-mining land uses, the required liability period and the following reclamation:

1. Types of reclamation work performed: Completion of the required backfilling, regrading, placement of soiling material, seeding, and drainage control of the subject areas.

2. Approximate date(s) of reclamation work performed: May 2002 to December 2012.

3. Description of reclamation results achieved: Restoration of the site to its approximate pre-mining configuration and establishment of the post-mining land uses.

4. Description of the post-mining land uses: Unmanaged forestry, fish and wildlife habitat, industrial and agricultural.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any federal, state or local government agency or authority, may within 30 days of December 10, 2013 submit written comments or objections concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation's office in Big Stone Gap, Virginia.
