In execution of a Credit Line Deed of Trust dated August 29, 2008, of record in the Circuit Court Clerk’s Office for Dickenson County, Virginia in Deed Book 457, Page 394, the undersigned Substitute Trustee (hereinafter “Trustee”) will, on Tuesday, December 17, 2013, at 2:00 p.m., at the front doors of the Dickenson County Courthouse, Main Street, Clintwood, Virginia, offer for sale at public auction to the highest bidder the following property with improvements thereon:

All that certain tract or parcel of land, with all the appurtenances thereto belonging, situate, lying and being on Caney Ridge in the Kenady Magisterial District of Dickenson County, Virginia, and being more particularly bounded and described as follows:

BEGINNING on an iron post; S 79 15 E 100 feet to a stake at the edge of a road; thence, S 34 27 W 183.41 feet with the road to a stake in a curve; thence, S 88 23 W 76.72 feet with the road to a stake, corner to Lot No. 8; thence, S 79 15 E 20.00 feet to the BEGINNING, containing 0.34 acres, more or less, and being the same land conveyed to Rodney D. O’Quin and Donna P. O’Quin by Jane H. Mullins by deed of record in Deed Book 446, Page 092 in the Clerk’s Office of the Circuit Court of Dickenson County, Virginia.

There is excepted and reserved from this conveyance such of the coal, oil, gas, minerals, rights, privileges, etc., that have been heretofore sold or excepted from said property. This property is made subject to and/or benefit of those additional superior liens, mechanics’ liens, restrictions, covenants, easements, rights of way, and conditions applicable to said real estate, if any there be, as contained in prior deeds properly of record.

Bids may be solicited in parcels or in bulk, in the Substitute Trustee’s discretion. Deposit of $2,000.00 cash or check drawn upon certified funds (no personal or cashier’s checks drawn upon uncertified funds accepted without prior Trustee approval) for the bid shall be required to qualify as a bidder before the sale, except from the Noteholder, or a deposit of 10% of the sale price, whichever is lower. Deposit, without interest, is applied to the purchase price at settlement. Settlement will be held on or before 15 days after the sale. The Trustee reserves the right to extend the date of settlement as may be necessary to complete arrangements for settlement. The Trustee also reserves the right to amend or supplement the terms of sale by verbal announcements during the sale, modify the requirements for bidders’ deposits, withdraw all or part of the property from the sale before the commencement of bidding, recess the sale, and conduct such other sales as the Trustee may determine in her discretion.

The balance of the purchase price shall be in cash or its equivalent. The property and any improvements thereon shall be sold in “AS IS, WHERE IS” condition without any warranties. The purchaser recognizes and agrees that any investigation, examination, or inspection of the Property is within the control of the owner or owners or other parties in possession and their agents and not within the control of the Trustee, the Noteholder, or their successors or assigns. The purchaser will be required to sign a Memorandum of Sale incorporating all the terms of the sale. Written notice has been sent to the owner(s) pursuant to Virginia law.

Coal Technology Inter-national, LLC, P.O. Box 191, Abingdon, Virginia 24212-0191 is applying to the Virginia Division of Mined Land Reclamation for renewal of the referenced permit in order to continue operations at the following location:

Approximately 1.3 miles northwest of Trammel, Virginia on McClure Creek in Dickenson County, off Routes 63 and 715, within the Nora, VA USGS quadrangle at approximately 37∞ 01' 50" latitude, 82∞ 18' 30" longitude.

Drainage and wastewater resulting from the operation will be discharged as follows:

1. Receiving stream(s): McClure Creek

2. Type of treatment: Sedimentation ponds treating surface runoff and process water from preparation plant and loading facilities at the minesite described above

3. All discharges are existing and are located within the mine site as described above

A copy of the renewal application are available for inspection and public comment at the Dickenson County Building Inspector’s office in Clintwood, Virginia. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the application, or an officer or head of any federal, state, or local government agency or authority may within 30 days of December 18, 2013 submit written comments or objections to the Division of Mined Land Reclamation concerning the application, and may also request, in writing, that the Division hold an informal conference concerning the application. Requests for an informal conference shall follow the requirements of 4VAC25-130-773.13c of the Virginia Coal Surface Mining Reclamation Regulations.

PUBLIC NOTICE

ENVIRONMENTAL PERMIT

PURPOSE OF NOTICE: To seek public comment on a draft permit from the Department of Environmen-tal Quality that will allow excavation and filling of stream channels and wetland areas in Dickenson County, Virginia.

PUBLIC COMMENT PERIOD: For 30 days, starting from the day after the notice is in the newspaper.

PERMIT NAME: Virginia Water Protection Permit issued by DEQ, under the authority of the State Water Control Board.

APPLICANT NAME, ADDRESS AND PERMIT NUMBER: Paramont Coal Company Virginia, LLC; 5703 Crutchfield Drive, Norton, VA 24273; VWP Permit #11-1758.

PROJECT DESCRIPTION: The Paramont Coal Company Virginia, LLC has applied for a new Virginia Water Protection permit for the proposed Cabin Ridge Surface Mine. The applicant proposes to conduct mining operations and place fill within approximately 7,720 linear feet of stream channel and 0.03 acres of wetlands. These waterways and wetlands resources are located on or adjacent to tributaries to the Russell Fork River (Right Fork and Fryingpan Creek). A watershed is the land area drained by a river and its incoming streams. To compensate for the proposed impacts, the applicant will create and/or restore an equivalent amount of stream channels and wetland areas. DEQ’s preliminary decision is to approve the permit.

HOW TO COMMENT AND/OR REQUEST A PUBLIC HEARING: The Department of Environmen-tal Quality accepts comments and requests for public hearing by email, fax or postal mail. All comments and requests must be in writing and be received by DEQ during the comment period. Submittals must include the names, mailing addresses and telephone numbers of the commenter/requester and of all persons represented by the commenter/ requester. A request for public hearing must also include: 1) The reason why a public hearing is requested. 2) A brief, informal statement regarding the nature and extent of the interest of the requester or of those represented by the requester, including how and to what extent such interest would be directly and adversely affected by the permit. 3) Specific references, where possible, to terms and conditions of the permit with suggested revisions. A public hearing may be held, including another comment period, if public response is significant, based on individual requests for a public hearing, and there are substantial, disputed issues relevant to the permit.
