In execution of the Deed of Trust dated March 10, 2005, in the original principal amount of $81,200.00, recorded  as Inst. 200501048, in the Clerk's Office of the Circuit Court for the County of Wise, Virginia, default having occurred in the payment of the indebtedness thereby secured and at the request of the holder of the note, the undersigned, as Substitute Trustees, any of whom may act, will sell at public auction at the front entrance of the Circuit court for the County of Wise on December 19, 2013, at 10:30 a.m., the property located at the above address and described as Lot 8 and the western 1/2 of Lot 9 adjoining Lot 8, Block 187, Big Stone Gap Improvement Company's Plat 5, County of Wise, Virginia.  

TERMS: CASH.  PROPERTY SOLD AS IS WITH SPECIAL WARRANTY OF TITLE.  A deposit of $    7,000.00 or 10% of the successful bid amount (whichever is lower) will be required immediately of the successful bidder, in cash, cashier's check or certified funds only payable to "FIRST COLONY TRUSTEES, LLC, TRUSTEE", balance due within 15 days from date of sale.  No personal checks accepted.  Upon purchaser's default, the deposit shall be forfeited and the property resold at the risk and costs of the defaulting purchaser.  Sale is subject to post sale confirmation and audit of the status of the loan including, but not limited to, determination of whether the borrower filed for bankruptcy protection, entered into any repayment agreement, reinstated or paid off the loan prior to the sale.  In any such event, the sale shall be null and void, and the Purchaser's sole remedy, in law or equity, shall be the return of the deposit without interest.  Sale is subject to all prior liens, easements, restrictions, covenants, reservations and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises.  Real estate taxes will be adjusted to the date of sale.  All costs of conveyance, deed, examination of title, recording charges and grantor's tax will be at the cost of the purchaser.  All risks of casualty pass to the successful bidder.  Additional terms may be announced at the time of sale.  Time is of the essence.

BLASTING SCHEDULE

In compliance with Section 4 VAC 25-130-816.64 in Chapter 19 of the Virginia Coal Surface Mining Reclamation Regulations, notice is hereby given that True Energy Fuels, LLC having been issued Surface Mine Permit No. 1102056 will be conducting blasting on the area covered by the permit located in Wise County, approximately one mile west of Pound, Virginia on South Fork of Pound River off State Route 671. The permit area is located on the Pound and Flat Gap USGS quadrangle at N. 3,587,500.7010 and E. 10,280,425.1091 (NAD 83). The blasting will comply with applicable state and federal laws. Access to the blasting area will be controlled to prevent unauthorized entry at least ten (10) minutes prior to any blasting event. A warning signal, indicated by three (3) long blasts on an air horn, will be sounded to clear the area. Then another warning signal indicated by two (2) long blasts on an air horn, a two minute delay, then one (1) long horn blast prior to the blasting and an all-clear signal indicated by three (3) short blasts will be audible within a range of one-half mile from the point of the blast in accordance with applicable State and Federal laws.

Blasting will not be conducted at times other than those announced except in emergency situations where weather or public safety requires unscheduled detonation as approved by the regulatory authority.

The Wise County School Board is soliciting conceptual proposals under the Public-Private Education Act of 2002 (the “PPEA”), as amended, from private entities who wish to design, schedule, construct, and improve road systems in the Union High School, Powell Valley Middle School and Powell Valley Primary School campus area.

This Request for Proposals is being issued as a response to an “Unsolicited Proposal” pursuant to Virginia’s Public Private Education Facilities and Infrastructure Act of 2002 (the “PPEA”), Virginia Code Sections 56.575.1 through 56-575.16 (1950, as amended) and other law. The School Division has determined that this is a qualifying project, there is a need for this project, and private involvement will provide the project to the public in a timely and cost effective fashion. Procurements under the PPEA are not subject to the Virginia Public Procurement Act and may be conducted using procedures consistent with those used for competitive negotiation of non-professional services under the Virginia Public Procurement Act. The Wise County School Board will use such procedures in this PPEA procurement. The Wise County School Board’s goal in this procurement is to enter into a Comprehensive Agreement under the PPEA and other law with the Proposer or Proposers who are fully qualified and best suited to satisfy Wise County Public Schools’ needs expressed in this Request for Proposal (RFP).

Initial conceptual proposals will be accepted until 4:00 PM, January 16, 2013 at the division office of The Wise County School Board, 628 Lake Street, Wise, VA, 24293. To be considered, completed proposals must be received at The Wise County School Board’s address on or before this date. Firms mailing qualifications should plan for adequate normal mail delivery time to ensure timely receipt.
