TERMS OF SALE: The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust to be announced at the time of sale. A deposit of $5,000.00, or 10% of the sale price, whichever is lower, in cash or cashier’s check payable to the SUBSTITUTE TRUSTEE will be required at the time of sale. The balance of the purchase price, with interest at the rate contained in the Deed of Trust Note from the date of sale to the date said funds are received in the office of the SUBSTITUTE TRUSTEE, will be due within fifteen (15) days of sale. BEING the same property conveyed unto Laurence Everett Hall and Jean W. Hall by deed dated May 10, 2002 from Juanita B. Hale, single, which said deed is of record in the Wise County Circuit Court Clerk’s Office as Instrument No. 200202270 and reference to which is hereby specifically made.

There is excepted and reserved from this conveyance such of the coal, oil, gas, minerals, rights, privileges, etc., that have been heretofore sold or excepted from said property. This property is made subject to and/or benefit of those additional superior liens, mechanics’ liens, restrictions, covenants, easements, rights of way, and conditions applicable to said real estate, if any there be, as contained in prior deeds properly of record.

Bids will be solicited separately or in bulk, in the Trustee’s discretion. AMBROSE BRANCH COAL COMPANY, INC., P.O. Box 806, Pound, Virginia 24279 is applying to the Virginia Division of Mined Land Reclamation for Revision No. 1008963 to its permit 1500883 to conduct coal surface mining and reclamation operations at the following location: in Cavenger Hollow of Indian Creek of the Pound River. The site is on the Pound quadrangle. The coordinates of the site are 3570570.072 North and 10290114.0037 East.

The revision involves no change to the existing NPDES outfalls 001, 004, 005, and 006 which flow into Cavenger Hollow.

Drainage and waste water resulting from the permitted operation will be discharged from existing outfalls into Cavenger Hollow of Indian Creek of the Pound River.

A copy of the application materials is available for public inspection and comment at the WISE COUNTY COURTHOUSE. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the proposed operation, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of December 24, 2013 submit written comments or objections to the Division of Mined Land Reclamation concerning the proposed operation (and may also request, in writing, that the Division hold an Informal Conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130-773.13(c) of the Virginia Coal Surface Mining Reclamation Regulations.

American Towers LLC is proposing to construct a 290-foot overall height self-support telecommunications tower at 8236 Indian Creek Rd, Wise, Wise County, VA, Tax Parcel ID 002710. 

The new tower structure will be lit with dual red/white, medium intensity flashing strobe with steady burning red side markers and the tower facility will include a 100’ by 100’ lease area and associated easements, along with a 30-ft buffer surrounding the lease area. American Towers LLC seeks comments from all interested persons on any potential significant impact the proposed action could have on the quality of the human environment pursuant to 47 C.F.R. Section 1.1307, including potential impacts to historic or cultural resources that are listed or eligible for listing in the National Register of Historic Places.  Interested persons may review the project application pending with the Federal Communications Commission (FCC) at www.fcc.gov/asr/applications by entering Form 854 File No. A0863965.
