TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The object of this suit is to partition the real estate, in one of the modes prescribed by law, and particularly so as to allow the plaintiffs to acquire the interests outstanding in the real estate described in the style of this suit by purchasing the shares of the other parties in exchange for the fair market value of their respective shares, less their proportionate share of costs incident hereto.

An Affidavit having been made and signed that there are or may be unknown parties in interest in said real estate, whose names and addresses are unknown, it is hereby ORDERED that each of said parties appear on or before February 10, 2014, and do whatever is necessary to protect their interest in said land.

ENVIRONMENTAL PERMIT

PURPOSE OF NOTICE: To seek public comment on draft permits from the Department of Environmental Quality that will allow the release of treated wastewater into two separate water bodies in Dickenson County, Virginia.

PUBLIC COMMENT PERIOD: 30 days from December 18, 2013

PERMIT NAME: Virginia Pollutant Discharge Elimination System – Wastewater issued by DEQ, under the authority of the State Water Control Board.

APPLICANT NAME, ADDRESS AND PERMIT NUMBER: Dickenson County Public Schools, PO Box 1127, Clintwood, VA 24228; VPDES Permit Numbers VA0027421 (Ervinton Elementary School Sewage Treatment Plant) and VA0027464 (Sandlick Elementary School Sewage Treatment Plant.)

FACILITY NAME AND LOCATION: Ervinton Elementary School, 195 Ervinton Circle, Nora, VA 24272; Sandlick Elementary School, 186 Anderson Lane, Birchleaf, VA 24220.

PROJECT DESCRIPTION: Dickenson County Public Schools has applied for reissuance of permits for the publically owned Ervinton Elementary School and Sandlick Elementary School sewage treatment plants. The applicant proposes to release treated sewage wastewater from the Ervinton Elementary School STP and the Sandlick Elementary School STP into two separate water bodies. The Ervinton Elementary School sewage treatment facility proposes to release the treated sewage wastewater at a rate of 5,300 gallons per day in McClure River and the Sandlick Elementary School sewage treatment facility proposes to release the treated sewage wastewater at a rate of 10,000 gallons per day in Russell Fork River, both in the Big Sandy River watershed. A watershed is the land area drained by a river and its incoming streams. Sewage sludge from the Ervinton Elementary School and the Sandlick Elementary School treatment process will be disposed of by a licensed contractor, who will pump the contents of the sewage treatment works as needed and transport the sludge in a truck-mounted watertight tank to either the Town of Haysi Sewage Treatment Plant (VA0067571) or the Town of Clintwood Sewage Treatment Plant (VA0026565) where additional treatment and final disposal will be accomplished. The permits will limit the following pollutants to amounts that protect water quality: pH, biochemical oxygen demand, total suspended solids and total residual chlorine.

HOW TO COMMENT AND/OR REQUEST A PUBLIC HEARING: DEQ accepts comments and requests for public hearing hand-delivery, by email, fax or postal mail. All comments and requests must be in writing and be received by DEQ during the comment period. Submittals must include the names, mailing addresses and telephone numbers of the commenter/requester and of all persons represented by the commenter/ requester. A request for public hearing must also include: 1) The reason why a public hearing is requested. 2) A brief, informal statement regarding the nature and extent of the interest of the requester or of those represented by the requester, including how and to what extent such interest would be directly and adversely affected by the permit. 3) Specific references, where possible, to terms and conditions of the permit with suggested revisions. A public hearing may be held, including another comment period, if public response is significant, based on individual requests for a public hearing, and there are substantial, disputed issues relevant to the permit.
