BLASTING SCHEDULE

In compliance with Section V25-130-816.64 of Virginia Coal Surface Mining Regulations, notice is hereby given that Meg-Lynn Land Co., P.O. Box 3499, Wise, Virginia 24293, having been issued Surface Mine Permit 1101800 on the area covered by the permit located approximately 0.3 mile northeast of Roaring Fork in Wise County, Virginia, will be conducting blasting on the area covered by the permit. Blasting will be in accordance with all applicable state and federal laws and will commence according to the following schedule of dates and times as approved by the regulatory authority.

Access to the blasting area will be controlled to prevent unauthorized entry at least ten (10) minutes prior to any blasting event. A warning signal indicated by three long blasts on an air horn will be sounded to clear the area. Then another warning signal indicated by two long blasts on an air horn, two-minute delay, then one long horn blast prior to the blasting and an all-clear signal indicated by three short blasts will be audible within a range on one-half mile from the point of the blast in accordance with applicable State and Federal laws.

Also, blasting will not be conducted at times other that those announced except in emergency situations where rain, lightning, atmospheric conditions, or operator or public safety requires unscheduled detonation as approved by the regulatory authority. This schedule will be republished and redistributed at least every 12 months. In addition to residents, each person working within one-half mile of the permit area shall be notified of the meaning of blasting signals.

The Wise County School Board is soliciting conceptual proposals under the Public-Private Education Act of 2002 (the “PPEA”), as amended, from private entities who wish to design, schedule, construct, and improve road systems in the Union High School, Powell Valley Middle School and Powell Valley Primary School campus area.

This Request for Proposals is being issued as a response to an “Unsolicited Proposal” pursuant to Virginia’s Public Private Education Facilities and Infrastructure Act of 2002 (the “PPEA”), Virginia Code Sections 56.575.1 through 56-575.16 (1950, as amended) and other law. The School Division has determined that this is a qualifying project, there is a need for this project, and private involvement will provide the project to the public in a timely and cost effective fashion. Procurements under the PPEA are not subject to the Virginia Public Procurement Act and may be conducted using procedures consistent with those used for competitive negotiation of non-professional services under the Virginia Public Procurement Act. The Wise County School Board will use such procedures in this PPEA procurement. The Wise County School Board’s goal in this procurement is to enter into a Comprehensive Agreement under the PPEA and other law with the Proposer or Proposers who are fully qualified and best suited to satisfy Wise County Public Schools’ needs expressed in this Request for Proposal (RFP).

A&G Coal Corporation is applying for bond reduction on Increment 3 of Permit No. 1102052 located in Wise County, approximately two miles northeast of Appalachia on Kelly Branch. This permit consists of 1,340.9 acres with Increment 3 acreage of 486.72 ac. As provided by § 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount on Increment 3 of $1,461,000 in the form of a surety bond posted for this permit be reduced by $876,600. The total permit bond is currently $2,238,600 for increments 2, 3, & 4. The bond reduction on Increment 3 will bring the total posted bond on Increments 2, 3, & 4 to $1,362,000.

This bond reduction request is based on the following Phase I reclamation:

3. Backfilling and grading has been completed on Increment 3.

4. Backfilling and grading operations were completed in Fall 2012, seeding occurred Fall 2013.

5. Backfilling and grading has been completed and vegetation established on disturbed area.

6. An unmanaged forestry post-mining land use can be implemented on the backfilled/regraded area, seeding has been completed.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any federal, state or local government agency or authority, may within 30 days of January 10, 2014, submit written comments or objections concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference.
