This suit is for the purpose of selling those certain tracts or parcels of real estate containing two (2) acres; a .5 acre of vacant land and a .304 acre tract of vacant land and being the same land which was conveyed to Harry L. Stanley and Emma Lois Stanley by of record in Deed Book 142, page 084; Deed Book 159, page 403 and Deed Book 132, page 530, respectively, of the Circuit Court Clerk’s Office and devised to Emma Lois Stanley by Harry L. Stanley in Will Book 16, page 92 in said Clerk’s Office.

An affidavit having been made that there may be potential unknown heirs, devisees and successors in interest of Emma Lois Stanley who may have an interest in the property that is the subject of this suit and that their names, whereabouts and addresses, if any, are unknown, it is hereby ordered that such persons appear on or before the 27th day of June, 2014 and take such steps as may be necessary to protect their interests in this suit.

And, it is further ORDERED that this order be published once a week for four successive weeks in The Dickenson Star, a newspaper of general circulation in the County of Dickenson; and that a copy of this order be posted at the front door of the Courthouse wherein this Court is held.

Terms of Sale: The Successful Bidder shall make a ten percent (10%) deposit at the time of sale, subject to the exception that the Trustee reserves the right to modify or waive the deposit requirement if the Noteholder is the successful bidder. The entire amount of the successful bid must be paid in full by certified or bank cashier’s check within thirty (30) days after sale, and Time is of the Essence as to the closing date and payment of the purchase price. The Property will be sold “AS IS, WHERE IS” and title will be conveyed by Special Warranty Deed. The purchaser of the Property will be required to pay all closing costs except the Grantor’s Tax, and real estate taxes will be pro-rated as of the original date of sale. The purchaser of said premises will at the time and place of sale, sign a memorandum of purchase and an agreement to comply with the terms and conditions of the sale herein contained. The Bidding will be kept open after the property is struck down; and in case any purchaser shall fail to comply with any of the above conditions of sale, the property so struck down will be again put up for sale under these same terms of sale, and the original purchaser will be held liable for any deficiency there may be between the sum for which the property may be purchased on the resale, and also for any costs or expenses incurred on such resale. BLASTING SCHEDULE

In compliance with Section 4 VAC 25-130-816.64 of the Virginia Coal Surface Mining Reclamation Regulations, notice is hereby given that Paramont Coal Company Virginia, LLC, having been issued Surface Mine Permit No. 1102098, will be conducting blasting operations on the permit area. The permit area is located approximately 4 miles northeast of Trammel off State Routes 600 and 699 in Dickenson County. Access to the blasting area will be controlled to prevent unauthorized entry at least ten (10) minutes prior to any blasting event. A warning signal, indicated by three long blasts on an air horn, will be sounded to clear the area. Then another warning signal indicated by two long blasts on an air horn, two minute delay, then one long horn blast prior to the blasting and an all-clear signal indicted by three short blasts will be audible within a range of one-half mile from the point of the blast in accordance with applicable State and Federal laws.

Also, blasting will not be conducted at times other than those announced except in emergency situations where rain, lightning, atmospheric conditions, or operator or public safety requires unscheduled detonation as approved by the regulatory authority.

Anyone owning a dwelling or structure located within one-half mile of the permit boundary desiring to have a pre-blast survey conducted may notify the Division of Mined Land Reclamation, P.O. K.M.H. Energy Corporation is applying for bond reduction on permit no. 1100822 located in Dickenson County approximately 2 mi. east of Clinchco on Mill Creek off Rt. 664, within the Haysi Virginia USGS quadrangle at approximately 37? 09' 30" latitude and -82? 19' 08" longitude. The permit consists of 51.0 acres which are bonded for $153,500.00 in the form of a certificate of deposit and cash. As provided by 4VAC25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the applicant is requesting a bond reduction of $9000.00 on increment no. 2, consisting of 3.23 acres.

This bond reduction request is based on the following reclamation:

Establishment of the industrial-manufacturing post-mining land use (construction and excavation company shop building and equipment storage/parking)

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any federal, state, or local government agency or authority, may within 30 days of May 7, 2014 submit written comments or objections concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. Bise Straight Dock Company, LLC, P. O. Box 190 Appalachia, VA 24216 is applying to the Virginia Division of Mined Land Reclamation for Phase III bond release on the Bise Straight Dock Loading Area of Permit No.1301629 located in Dickenson County located 2.80 miles Southeast of Clintwood, VA on Camp Creek on Route 83. The post mining land use for this permit area is unmanaged forest. The northing and easting are 3593276 and 10343691, respectively. The permit area consists of approximately 4.47 acres. The Clintwood, Virginia USGS 7.5-minute topographic map was used to describe the location of the permit area.

As provided by § 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $16,800 in the form of a Certificate of Deposit posted for this permit be reduced by $16,800. This bond release request on this permit is based upon the completion of reclamation liability for this permit area of 4.47 acres.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any Federal, State, or Local Government agency or authority may within 30 days of May 14, 2014 submit written comments or objections, concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference.
