This suit is for the purpose of selling those certain tracts or parcels of real estate containing two (2) acres; a .5 acre of vacant land and a .304 acre tract of vacant land and being the same land which was conveyed to Harry L. Stanley and Emma Lois Stanley by of record in Deed Book 142, page 084; Deed Book 159, page 403 and Deed Book 132, page 530, respectively, of the Circuit Court Clerk’s Office and devised to Emma Lois Stanley by Harry L. Stanley in Will Book 16, page 92 in said Clerk’s Office.
An affidavit having been made that there may be potential unknown heirs, devisees and successors in interest of Emma Lois Stanley who may have an interest in the property that is the subject of this suit and that their names, whereabouts and addresses, if any, are unknown, it is hereby ordered that such persons appear on or before the 27th day of June, 2014 and take such steps as may be necessary to protect their interests in this suit.
And, it is further ORDERED that this order be published once a week for four successive weeks in The Dickenson Star, a newspaper of general circulation in the County of Dickenson; and that a copy of this order be posted at the front door of the Courthouse wherein this Court is held.

SUBSTITUTE TRUSTEE'S SALE OF
IN DICKENSON COUNTY VIRGINIA
In execution of a Deed of Trust dated April 13, 2006, and recorded in the Office of the Clerk of the Circuit Court of Dickenson County, Virginia in Deed Book 424, Page 366, and with the undersigned being appointed Substitute Trustee by document of record in Deed Book 514, Page 639, and further a Corrected Deed of Trust dated April 27, 2014 and recorded in the aforesaid Clerk’s Office in Deed Book 516, Page 58, the undersigned Substitute Trustee will offer for sale at public auction all that certain property, together with all improvements thereon and appurtenances thereunto belonging, more particularly described in the said Deeds of Trust, having a street address of 404 Shifty Lane, Clinchco, Virginia; a tax map number of 177C-295 (1263) and 177C-294 (1264), and briefly described as follows:
Those four (4) certain lots or parcels of land, situate on McClure River, one (1) mile South of Clinchco, in Dickenson County, Virginia, and being more particularly known and designated as Lots Nos. 9, 10, 11 and 12, as shown on plat entitled, “John G. Kerr & wife, lots near Clinchco* * * *”, which plat is of record in the Office of the Clerk of the Circuit Court of Dickenson County, Virginia, in Plat Book No. 1, page 51.”
AND BEING, the same real property more particularly described in that certain Deed dated October 22, 1976 and of record in the Circuit Court Clerk’s Office of Dickenson County, Virginia, in Deed Book 181, Page 554.
Sale shall be made subject to all rights, reservations, restrictions, covenants, and easements of record in the aforesaid Clerk's Office which may affect the title to the real property hereinabove mentioned.

Time of Sale: 10:00 a.m.
Place of Sale: Front Steps of the Dickenson County Courthouse, Main Street, Clintwood, Virginia.
Terms of Sale: The Successful Bidder shall make a ten percent (10%) deposit at the time of sale, subject to the exception that the Trustee reserves the right to modify or waive the deposit requirement if the Noteholder is the successful bidder. The entire amount of the successful bid must be paid in full by certified or bank cashier’s check within thirty (30) days after sale, and Time is of the Essence as to the closing date and payment of the purchase price. The Property will be sold “AS IS, WHERE IS” and title will be conveyed by Special Warranty Deed. Risk of loss will pass at the time of sale, and neither the Substitute Trustee nor the Noteholder will deliver possession of the Property to the successful bidder. Substitute Trustee shall have no duty to obtain possession for purchaser. All risks of casualty pass to successful bidder at conclusion of bidding. Sale is subject to post-sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower(s) entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the purchaser’s sole remedy, in law or equity, shall be the return of the purchaser’s deposit without interest. Additional terms to be announced at the sale. The purchaser of the Property will be required to pay all closing costs except the Grantor’s Tax, and real estate taxes will be pro-rated as of the original date of sale. The purchaser of said premises will at the time and place of sale, sign a memorandum of purchase and an agreement to comply with the terms and conditions of the sale herein contained. The Bidding will be kept open after the property is struck down; and in case any purchaser shall fail to comply with any of the above conditions of sale, the property so struck down will be again put up for sale under these same terms of sale, and the original purchaser will be held liable for any deficiency there may be between the sum for which the property may be purchased on the resale, and also for any costs or expenses incurred on such resale. If for any reason the Substitute Trustee fails to convey title to the Property to the purchaser, the purchaser's sole remedy is the return of the Deposit paid by the purchaser on the date of the foreclosure sale.

Bise Straight Dock Company, LLC, P. O. Box 190 Appalachia, VA 24216 is applying to the Virginia Division of Mined Land Reclamation for Phase III bond release on the Bise Straight Dock Loading Area of Permit No.1301629 located in Dickenson County located 2.80 miles Southeast of Clintwood, VA on Camp Creek on Route 83. The post mining land use for this permit area is unmanaged forest. The northing and easting are 3593276 and 10343691, respectively. The permit area consists of approximately 4.47 acres. The Clintwood, Virginia USGS 7.5-minute topographic map was used to describe the location of the permit area.
As provided by § 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $16,800 in the form of a Certificate of Deposit posted for this permit be reduced by $16,800. This bond release request on this permit is based upon the completion of reclamation liability for this permit area of 4.47 acres.
Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any Federal, State, or Local Government agency or authority may within 30 days of May 14, 2014 submit written comments or objections, concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation’s office in Big Stone Gap, Virginia.

Code of Virginia Section 45.1-361.30 identifies persons with rights to file objections to the gas and oil operation.
