In execution of that certain Credit Line Deed of Trust dated June 03, 2015 and recorded in the Circuit Court Clerk's Office of Wise County, Virginia in as Instrument Number 201502605, and by virtue of the authority vested in the undersigned Substitute Trustee, any one of whom may act, by said Deed of Trust, and the Deed of Appointment of Substitute Trustee recorded in the Circuit Court Clerk's Office of Wise County, Virginia as Instrument Number 202002887, default having been made in the terms of the Note secured by the Deed of Trust, and having been requested to do so by the Holder of the Note, the undersigned Substitute Trustee will offer for sale at public auction the following property as described in said Deed of Trust:
All that certain tract or parcel of land situate, lying and being in Wise County, Virginia, in the Roberson Magisterial District of Wise County, Virginia, on the waters of bold Camp Creek, a tributary to Pound River, and more particularly bounded and described as follows, to-wit:
BEGINNING at an iron pin roof bolt six inches below grade, in the north rut of a newly bulldozed road, in the northeastern right of way line of the old C & O Railroad, in the line of Richard Mullins; thence S. 22 41 E 55.21 feet along the said N E. right of way line of rail road to a “X” chiseled on top of a triangle concrete monument, a corner to the said C & O R.R. and a corner to the said Richard Mullins and with the said Richard Mullins' line and leaving said C & O R.R. R O W N 52 11 E 314.84 feet, bordering property of Bert Adams and W W. G. Dotson, to an iron pipe 18 inches high, and driven against the southwest side of a fence post in a fence line on the north west side of a spur; thence N 44. 32 28 W 151.89 feet, bordering property of Jessee Moore to an iron pipe 24 inches high driven against and on the southeast side of a fence post, 2 feet southwest of an old fence on hillside; thence leaving the said outside line of the said Richard Mullins S 33 08 22 W 299.01 feet to the BEGINNING, and containing seven hundred and two one-thousandths (0.702) of an acre more or less, (J C Osgood, Surveyor on 04-17-1976. Field Book No 19, page 63).
There is also granted to the Grantee the use of any and all easements, right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise, and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
There is also conveyed by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.
This conveyance is made subject to all prior recorded conditions restrictions, reservations, easements and conveyances affecting the property hereby conveyed.
BEING the same property Adam Ryan Mullins acquired by deed dated June 01, 2015, from The Secretary of Housing and Urban Development, of record in the Circuit Court Clerk's Office of Wise County, Virginia as Instrument No. 201502604.
PLACE OF SALE: Front Steps of the Wise County Courthouse; Main Street, Wise Virginia.
DATE OF SALE: Thursday, August 13, 2020
TIME OF SALE: 10:00 A. M.
TERMS OF SALE: CASH. A deposit of 10% in cash or by check will be required of the successful bidder at the time of the sale and settlement in full shall be made within fifteen (15) days from date of sale at the office of said Substitute Trustee. The Substitute Trustee may change the terms of sale on the Date of Sale. The successful bidder will also be required to sign a Memorandum of a Foreclosure Sale.
This is an attempt to collect a debt and any information gathered will be used accordingly.
