In execution of that certain Deed of Trust dated August 06, 2008 and recorded in the Circuit Court Clerk's Office of Wise County, Virginia as Instrument Number 200803113, and by virtue of the authority vested in the undersigned Substitute Trustee, any one of whom may act, by said Deed of Trust, and the Deed of Appointment of Substitute Trustee recorded in the Circuit Court Clerk's Office of Wise County, Virginia as Instrument Number 202000499, default having been made in the terms of the Note secured by the Deed of Trust, and having been requested to do so by the Holder of the Note, the undersigned Substitute Trustee will offer for sale at public auction the following property as described in said Deed of Trust:
All of those certain tracts, pieces or parcels of land situate on Bear Branch in the County of Wise, Virginia, and more particularly bounded and described as follows, to-wit:
BEGINNING at a point in the line of Michael Addison (Instrument # 980003109) and with the original line of Hazel Joyner *DB 371, Page 322) N 0º 00' 46” E 110.98' to a point; thence with new division thru Joyner S 82º 45' 57” E. 52.82' to an iron pin the line of David M. Sturgill and Diane Sturgill (DB 458, PG 219); thence with said S 17º 30' 00” E 65.32' to a railroad spike; thence leaving Sturgill and with new division S 59º 44' 46” W 83.43' to the beginning containing 0.1278 acres.
BEGINNING at a railroad spike in the Eastern edge of a 10' road; thence with road N 15º 24' 01” W 89.26' to a railroad spike; thence leaving said road and with new division lines three (3) calls N 60º 05' 33” E 50.94' to an iron pin; thence N 11º 13' 54” E 16.05 to an iron pin; thence S 82º 45' 57” E 3.51' to a point in the original line of Hazel Joyner (DB 371, PG 322); thence with Joyner and original line of Michael Addison (Instrument# 980003109) S 0º 00' 46” W 110.98' to a point; thence S 59º 44' 46” W 31.30 to the beginning containing 0.0904 acres.
BEING the same property conveyed to Tonya Michelle Yates by Deed dated August 06, 2008 and recorded in the Wise County Circuit Court Clerk's Office as Instrument Number 200803112.
There is also granted to the Grantee the use of any easements, right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise, and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
There is also conveyed by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.
This conveyance is made subject to all prior recorded conditions, restrictions, reservations, easements, and conveyances affecting the property hereby conveyed.
There is further conveyed the title to a 1991 Clayton MH VIN #CLH015782TNAB

TIME OF SALE: 10:15 A. M.
TERMS OF SALE: CASH. A deposit of 10% in cash or by check will be required of the successful bidder at the time of the sale and settlement in full shall be made within fifteen (15) days from date of sale at the office of said Substitute Trustee. The Substitute Trustee may change the terms of sale on the Date of Sale. The successful bidder will also be required to sign a Memorandum of a Foreclosure Sale.
