In execution of a certain Deed of Trust dated April 6, 2010, in the original principal amount of $129,000.00 recorded in the Clerk's Office, Circuit Court for Wise County, Virginia as Instrument No. 201001330. The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Wise County and the City of Norton, 206 East Main Street, Wise, Virginia on October 28, 2021, at 10:00 AM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows:

ALL THOSE CERTAIN LOTS SITUATE, LYING AND BEING IN THE TOWN OF COEBURN IN THE LIPPS MAGISTERIAL DISTRICT OF WISE COUNTY, VIRGINIA, AND BEING MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS, TO WIT: ALL OF LOTS NUMBERED THIRTEEN (13), FOURTEEN (14), FIFTEEN (15), AND SIXTEEN (16), IN BLOCK NUMBER FIFTY-NINE (59) AS SHOWN ON A PLAT OF THE COEBURN HOME COMPANY ADDITION RECORDED IN DEED BOOK (PLAT BOOK) 32 AT PAGE 120, IN THE CLERK`S OFFICE FOR THE CIRCUIT COURT OF WISE COUNTY, VIRGINIA, REFERENCE TO WHICH IS HEREBY SPECIFICALLY MADE. RIGHT OF WAY TO AND FROM A WELL LOCATED ON THE PROPERTY TO THE WEST OF THE ABOVE DESCRIBED PROPERTY EITHER ON LOT 13 OR 14 ON SAID BLOCK, THE RIGHT TO USE WATER THEREFROM AND TO ENJOY ALL THE USE AND BENEFIT JOINTLY WITH THE OWNER OF THE MACIARA PHILLIPS HOME WHICH SAID RIGHTS ARE MORE PARTICULARLY DESCRIBED IN DEED BOOK 416, PAGE 106. THERE IS EXCEPTED FROM THE OPERATION OF THIS CONVEYANCE THE WESTERN HALF OF LOT 13 AS WAS CONVEYED TO KILGORE ENTERPRISES, INC. BY DEED DATED 8/13/1971, RECORDED IN WISE COUNTY DEED BOOK 447, PAGE 662. THERE IS FURTHER EXCEPTED ALL THE COAL, OIL, GAS AND OTHER MINERALS AND MINING RIGHTS WHICH MAY HAVE BEEN HERETOFORE EXCEPTED, RESERVED OR SOLD BY PRIOR OWNERS OF RECORD. THERE IS ALSO THE USE OF ANY AND ALL EASEMENTS, RIGHTS OF WAY, ROADWAYS, WATER RIGHTS, PIPELINE RIGHTS, SEWER SYSTEMS INCLUDING ANY FIELD LINES ATTACHED HERETO IN EXISTENCE AND WHICH LAWFULLY MAY BE USED BY OTHERS, WHETHER BY EXPRESS GRANT, PERSCRIPTIVE USE OR OTHERWISE, AND WHICH ARE APPURTEANT TO AND PART OF THE USE AND ENJOYMENT OF THIS PARTICULAR TRACT OF LAND. THERE IS ALSO ALL BUILDINGS, IMPROVEMENTS, FIXTURES, EASEMENTS AND APPLIANCES NOW OR HEREAFTER ATTACHED TO OR USED IN CONNECTION WITH THE PROPERTY HERIN DESCRIBED. LESS AND EXCEPT THAT PROPERTY CONVEYED IN DEED OF GIFT FROM IVAN W. BUCHANAN AND FAY E. BUCHANAN TO TERRY WAYNE BUCHANAN AND JANET LYNN BUCHANAN DATED 6/30/1997, RECORDED 6/30/1997 IN INTRUMENT NUMBER 970002501, CLERK`S OFFICE, WISE COUNTY, VIRGINIA.
TERMS OF SALE: ALL CASH. A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser's deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee's Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney.
