In execution of a certain Deed of Trust dated February 5, 1999, in the original principal amount of $10,000.00 recorded in the Clerk's Office, Circuit Court for Wise County, Virginia as Instrument No. 990000855 . The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Wise County and the City of Norton, 206 East Main Street, Wise, Virginia on August 19, 2022, at 9:00 AM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows:

ALL THAT CERTAIN LOT OR PARCEL OF LAND SITUATE, LYING AND BEING IN WISE COUNTY, VIRGINIA, NEAR CLINCH VALLEY COLLEGE AND EAST OF THE TOWN OF WISE, VIRGINIA, AND MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A STAKE IN THE LINE OF J. B. FRANKLIN AND AT THE EDGE OF A 14 FEET WIDE RIGHT OF WAY ADJACENT TO THE CLINCH VALLEY MANOR PROPERTY AND ALSO A CORNER TO THE MATTIE C. MULLINS PROPERTY; THENCE WITH THE FRANKLIN LINE IN A SOUTHERLY DIRECTION 125 FEET TO A STAKE; THENCE LEAVING THE FRANKLIN LINE AND RUNNING IN A WESTWARDLY DIRECTION 112 FEET TO A STAKE IN THE MATTIE C. MULLINS LAND; THENCE IN A NORTHERLY DIRECTION 125 FEET TO A STAKE IN THE EDGE OF THE AFORESAID 14 FEET WIDE RIGHT OF WAY AND THE ORIGINAL LINE BETWEEN MATTIE C. MULLINS AND THE CLINCH VALLEY MANOR PROPERTY; THENCE IN AN EASTERLY DIRECTION WITH SAID 14 FEET WIDE RIGHT OF WAY AND THE LINE OF CLINCH VALLEY MANOR A DISTANCE OF 75 FEET TO THE BEGINNING, TOGETHER WITH A PERMANENT EASEMENT FOR RIGHT OF WAY OF INGRESS AND EGRESS OVER SAID 114 FEET WIDE RIGHT OF WAY LEADING FROM THE STATE HIGHWAY TO THE HEREIN CONVEYED PROPERTY.
TERMS OF SALE: ALL CASH. A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser's deposit may be forfeited to Trustee. Time is of the essence. Substitute Trustee has identified an unreleased security instrument which may be superior to the subject Deed of Trust. Substitute Trustee disclaims any implication that the Property will be sold free and clear of all liens. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee's Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney.
