IN EXECUTION of a Deed of Trust dated the 1 st day of June, 2010, in principal amount of $58, 325. 04, recorded in the Clerk' s Office of the Circuit Court for Wise County, Virginia, as Instrument Number 201001804, default having occurred thereunder, and having been requested to do so by the Beneficiary, the undersigned Substitute Trustee who was appointed under Instrument No. 202300095, will offer for sale at public auction at the Eastern Front Door of the Wise County Courthouse, at 206 E . Main Street, in the Town of Wise, Virginia, [NOTICE: THIS SALE WILL NOT TAKE PLACE ON THE PREMISES OF THE PROPERTY BEING SOLD]

on the 9th day of

February, 2023, at 1:30 PM

the following described tract, lot, piece or parcel of land, rectangular in shape, one hundred (100) feet by approximately two hundred fifty (250) feet, situated in the City of Norton, Wise County, Virginia, and more particularly bounded and described as follows, to-wit:

BEGINNING at the west end of a large rock near a birch and near the center of the first left-hand branch of Benges Branch above the L&N railroad and about 1, 000 feet from the mouth of said small branch, also a corner to the Rimmer lands; thence N 3 30 W 250 feet, more or Less, to a point on top of a cliff; thence along the top of said cliff northeastwardly as the top of said cliff meanders 100 feet to a point on top of said cliff; thence south 330 E 250 feet more or less to a point at the center of the branch; thence south 82 10 W along the center of the branch to the point of Beginning.

BEING that same property conveyed unto Grantor by Deed dated May 3, 2010, which said Deed is recorded as Instrument No. 201001444 in the Clerk' s Office for Wise County, Virginia, reference to which said Deed is hereby made.

There is also a 1979 Clayton Doublewide Manufactured Home situate on the property to be sold at auction, either together with the land or separately, at the sole discretion of Trustee and/or Noteholder.

There is also granted to the Grantees the use of any and all easements, right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise and which are appurtenant to and part of the use and enj oyment of this particular tract of land.

There is also conveyed by this instrument all buildings, improvements , fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.

TERMS OF SALE: Cash. A deposit of 10% of the sale price in cash or certified check may be required at the time and place of sale with the balance of the sale price to be paid at settlement, to be held within THIRTY (30) days from the date of the sale; should purchaser fail to complete purchase within 30 days, the deposit is forfeited and the sale subj ect to termination or a charge of daily per diem interest thereon until closing date at option of Lienholder. The property and any improvements thereon shall be sold in "AS IS, WHERE IS" condition without any warranties. Title shall be transferred by Special Warranty Deed, and Buyer shall be responsible for all costs of conveyance including but not limited to deed preparation and all fees to transfer title. Sale is subject to such additional terms as Trustee may announce at the sale.

This is an attempt to collect a debt and any information obtained will be used for that purpose.
