WHEREAS, by Deed of Trust dated March 7, 2022, and recorded in the Clerk's Office of the Circuit Court of Wise County, Virginia, by Instrument Number 202201007, Billy R. Mickles, conveyed to Hanor Law Firm, PLLC, Trustee, the hereinafter described real estate to secure the payment of a note in the original principal amount of $72,500.00.
WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and Appalachian Community Federal Credit Union, the holder of said indebtedness has declared the entire amount due and payable as provided in said Deed of Trust, and the Substitute Trustee has been directed to foreclose the Deed of Trust in accordance with the terms thereof; and
WHEREAS, the public is hereby notified that the undersigned Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand, at the main entrance of Wise County Courthouse, 206 East Main Street Wise, Virginia, at 10:00 a.m. on June 14, 2023.

All that certain tract, piece or parcel of land, together with improvements situate thereon and appurtenances thereto appertaining, located in the City of Norton, Wise County, Virginia, and being more particularly bounded and described as follows, to-wit:
BEING a 0.34 acre parcel of land, a portion of Lots #27 and #28 of Plat #2 of Clear Creek Improvement Co. Wise County, Virginia. Being more particularly described as follows, to-wit:
BEGINNING at a point, corner to Parcel #1, a 0.34 acres parcel, and point in line to Lot #29; thence leaving corner of parcel #1 and with line of Lot #29 N 02° 06'' E, 119.00' to a point, corner to Parcel #3; thence leaving line of Lot #29 and with the southern line of Parcel #3 N 70° 03' E, 119.52' to a point in the line of Lot #26; thence leaving corner of Parcel #3 and with line of Lot #26 S 08° 09' E, 119.00' to a point, corner of Parcel #1; thence leaving line of Lot #26 and with the northern line of Parcel #1 S 72° 35' W 139.98' to the BEGINNING, containing 0.34 acres.
There is EXCEPTED AND RESERVED a ten foot right of way, five feet on the left and five feet on the right of the centerline of an existing ten foot paved driveway as described in Deed of record in the Office of the Circuit Court Clerk of Wise County, Virginia, in Deed Book 626, at Page 585.
BEING that same property conveyed unto Billy R. Mickles by Deed dated March 7, 2022, from William Riley Maggard, which said Deed is intended to be recorded simultaneously herewith in the Clerk's Office for Wise County, Virginia, reference to which said Deed is hereby made.
THERE IS ALSO GRANTED to the Grantees the use of any and all easements, rights of ways, roadways, water rights, pipeline rights, sewer systems, including field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use of otherwise and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
THIS DEED IS MADE SUBJECT to any and all existing reservations, easements, exceptions, conditions, restrictions and/or adverse conveyances as the same may lawfully affect the above-described property.
THERE IS ALSO CONVEYED BY THIS INSTRUMENT all buildings, improvements, fixtures, appliances and/or easements, now or hereafter attached to or used in connection with the property herein described; and SPECIFICALLY INCLUDING that certain 1982 Atlantic Manufactured Home now situate on a permanent foundation on the above-described property with Serial #21-2-850-3595A&B.
