In execution of a certain Deed of Trust dated September 26, 2003, in the original principal amount of $50,000.00 recorded in the Clerk's Office, Circuit Court for Wise County, Virginia as Instrument No. 200305254 . The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Wise County and the City of Norton, 206 East Main Street, Wise, Virginia or any such temporary alternative Circuit Court location designated by the Judges of the Circuit Court on November 6, 2023, at 2:30 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows:
ALL THOSE CERTAIN PARCELS OF LAND BEING IN THE GLADEVILLE DISTRICT OF WISE COUNTY, VIRGINIA, DESCRIBED AS FOLLOWS:
PARCEL #1: BEGINNING AT THE MOUTH OF BIG BRANCH AT AN OAK TREE, A CORNER TO THE STARNES TRACT OF LAND; THENCE DOWN GUEST RIVER AS IT MEANDERS TO A CHESTNUT ON A STEEP BANK ON THE EAST SIDE OF SAID RIVER; THENCE NORTHEAST DIRECTION UP THE HILL TO AN OAK TREE IN THE ORIGINAL LINE OF BETWEEN EMMETT DAY AND VIRGINIA COAL + IRON COMPANY; THENCE IN A WESTERN DIRECTION TO THE POINT OF BEGINNING. EXCEPTING FROM THE ABOVE BOUNDARY ALL THE LAND LYING AND BEING ON THE WEST SIDE OF THE ROAD THAT PASSES THROUGH AND ACROSS THIS TRACT OF LAND AND BEING ON THE UPPER SIDE OF SAID ROAD. THIS BEING SETOUT IN DEED BEARING DATE OF JANUARY 30, 1950, AND THE SAME BEING OF RECORD IN THE CLERK`S OFFICE OF WISE COUNTY IN DEED BOOK 293 AND PAGE 376.
PARCEL #2: ALL OF THE INTEREST THAT THOMAS J. GREEAR AND BRENDA HILL GREEAR OBTAINED IN THAT CERTAIN DEED OF CONVEYANCE DATED AUGUST 23, 1969, FROM FAYE MASSEY AND OTHERS RECORDED IN SAID CLERK`S OFFICE IN DEED BOOK 422, PAGE 381, AND SAID CONVEYANCE DESCRIBED AS ALL THE INTERESTS IN AND TO ALL OF THE REAL ESTATE OWNED BY ROSE ROBERTS AND WILLIE F. ROBERTS ON GUEST RIVER, GLADEVILLE DISTRICT, WISE COUNTY, VIRGINIA, AT THE TIME OF THEIR RESPECTIVE DEATHS.
TERMS OF SALE: ALL CASH. A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser's deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee's Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney.
