TRUSTEE'S SALE

OF VALUABLE REAL

ESTATE SITUATE IN

WISE COUNTY, VIRGINIA

In execution of a Deed of Trust dated September 24, 2008, and recorded in the Office of the Clerk of the Circuit Court of Wise County, Virginia as Instrument Number 200803949; and with the undersigned being appointed Substitute Trustee by document of record, the undersigned Substitute Trustee will offer for sale at public auction all that certain property, together with all improvements thereon and appurtenances thereunto belonging, more particularly described in the said Deed of Trust, having street address of 11446 Bedford Road, Coeburn, Virginia 24230; having parcel identification numbers of 007090 and briefly described as follows:

All those three certain lots, pieces or parcels of land situate, lying and being in the Lipps Magisterial District of Wise County, Virginia, about one mile West of the Town of Coeburn, and being a part of the land known as the Frazier Addition as shown on a Map which is of record in the Clerk's Office of Wise County, Virginia, in Plat Book 32, page 211, and which said lots are more particularly bounded and described as follows, to wit:

Lots Numbers 7, 8, and 9, in Block No. G of the Frazier Addition, fronting 50 feet each on Lee Street and running back between parallel lines 125 feet to an alley.

Being that same property heretofore conveyed unto

AND BEING the same property conveyed unto Samuel F. Holbrook and Nola Mae Holbrook by Deed dated the 10th day of June, 1948, from Jeanette Meade Dingus, which said Deed is recorded in Deed Book 285, page 087, and further BEING that same property conveyed by Deed dated September 18, 1948, from W.R. Kiser, Commissioner on the part of Tommie Merita Dingus, infant heir of Thomas A. Dingus, deceased, which said Deed is recorded in Deed Book 285, page 085, in the Clerk's Office for Wise County, Virginia, reference to which two said Deeds is hereby made. Samuel F. Holbrook died intestate on January 13, 1986, and title vested in his wife, Nola Mae Holbrook, under the intestate succession laws then in effect in the Commonwealth of Virginia.

Sale shall be made subject to all rights, reservations, restrictions, covenants, and easements of record in the aforesaid Clerk's Office which may affect the title to the real property hereinabove mentioned.

Date of Sale: July 18, 2024

Time of Sale: 1:45 p.m.

Place of Sale: Front Steps of the Wise County Courthouse, 206 W. Main St., Wise, Virginia.

Terms of Sale: The Successful Bidder shall make a ten percent (10%) deposit at the time of sale, subject to the exception that the Trustee reserves the right to modify or waive the deposit requirement if the Noteholder is the successful bidder. The entire amount of the successful bid must be paid in full by certified or bank cashier's check within thirty (30) days after sale, and Time is of the Essence as to the closing date and payment of the purchase price. The Property will be sold “AS IS, WHERE IS” and title will be conveyed by Special Warranty Deed. Risk of loss will pass at the time of sale, and neither the Trustee nor the Noteholder will deliver possession of the Property to the successful bidder. The purchaser of the Property will be required to pay all closing costs except the Grantor's Tax, and real estate taxes will be pro-rated as of the original date of sale. The purchaser of said premises will at the time and place of sale, sign a memorandum of purchase and an agreement to comply with the terms and conditions of the sale herein contained. The Bidding will be kept open after the property is struck down; and in case any purchaser shall fail to comply with any of the above conditions of sale, the property so struck down will be again put up for sale under these same terms of sale, and the original purchaser will be held liable for any deficiency there may be between the sum for which the property may be purchased on the resale, and also for any costs or expenses incurred on such resale. If for any reason the Substitute Trustee fails to convey title to the Property to the purchaser, the purchaser's sole remedy is the return of the Deposit paid by the purchaser on the date of the foreclosure sale.
