TRUSTEE'S SALE OF 272 Grandview Drive, Wise, Virginia

In execution of a Deed of Trust dated July 11, 2022, and recorded in the Office of the Clerk of the Circuit Court of Wise County, Virginia as Instrument Number 202203278; and with the undersigned being appointed Substitute Trustee by document of record, the undersigned Substitute Trustee will offer for sale at public auction all that certain property, together with all improvements thereon and appurtenances thereunto belonging, more particularly described in the said Deed of Trust, having street address of 272 Grandview Drive, Wise, Virginia 24293; having parcel identification number of 014300 and briefly described as follows:

BEGINNING at a cross filed on top of an iron pipe set in concrete, in field, corner to William E. Ferguson, 10 feet below center line of telephone line; and with the said Ferguson line one call only as follows: N 49 24 E 146.79 feet to a cross filed on top of an iron pin set in concrete on northwest side and 4 inches out from old whote (sic) post in line of row of white pines and 3 feet northeast of a 4 inch hemlock, corner to James Handy, and with the said Handy line one call only as follows: N 28 43 E 14.18 feet to a stake 6 inches southwest of a white marker post and 10 inches southeast of a 6 inch white pine in the southwest right of way line of Grandview Street and with said right of way line of said street, S 38 57 E 147.41 feet to a 14 inch locust marked for a corner on bench of hillside; S 44 29 W 279.55 feet to a stake 4 inches west of a 22 inch stooping black oak, corner tree in the original outside boundary line on a cliff N 38 46 W 121.48 feet to the BEGINNING, and containing seven hundred and seventy-two one thousandths (772/1000) of an acre.

AND BEING the same property conveyed unto Ronald R. Dunford and Jessica L. Dunford, by Deed dated July 29, 2021, a copy of which deed is of record in the Clerk's Office of the Circuit Court of Wise County, Virginia, as Instrument Number 202103384 reference to which deed is hereby made for a more particular description of the property herein mentioned.

Sale shall be made subject to all rights, reservations, restrictions, covenants, and easements of record in the aforesaid Clerk's Office which may affect the title to the real property hereinabove mentioned.

Date of Sale: July 18, 2024

Time of Sale: 1:30 p.m.

Place of Sale: Front Steps of the Wise County Courthouse, 206 W. Main St., Wise, Virginia.

Terms of Sale: The Successful Bidder shall make a ten percent (10%) deposit at the time of sale, subject to the exception that the Trustee reserves the right to modify or waive the deposit requirement if the Noteholder is the successful bidder. The entire amount of the successful bid must be paid in full by certified or bank cashier's check within thirty (30) days after sale, and Time is of the Essence as to the closing date and payment of the purchase price. The Property will be sold “AS IS, WHERE IS” and title will be conveyed by Special Warranty Deed. Risk of loss will pass at the time of sale, and neither the Trustee nor the Noteholder will deliver possession of the Property to the successful bidder. The purchaser of the Property will be required to pay all closing costs except the Grantor's Tax, and real estate taxes will be pro-rated as of the original date of sale. The purchaser of said premises will at the time and place of sale, sign a memorandum of purchase and an agreement to comply with the terms and conditions of the sale herein contained. The Bidding will be kept open after the property is struck down; and in case any purchaser shall fail to comply with any of the above conditions of sale, the property so struck down will be again put up for sale under these same terms of sale, and the original purchaser will be held liable for any deficiency there may be between the sum for which the property may be purchased on the resale, and also for any costs or expenses incurred on such resale. If for any reason the Substitute Trustee fails to convey title to the Property to the purchaser, the purchaser's sole remedy is the return of the Deposit paid by the purchaser on the date of the foreclosure sale.
