J. W. Construction Company, Inc. of P.O. Box 2470, Wise, VA 24293 is applying to the Virginia Mined Land Repurposing Program for a Phase II bond reduction on the entire permitted acreage for Permit No. 1102281 at the following location: 3 miles North of Wise on Turkey Branch near State Route 640. This permit consists of 99.45 acres bonded under Pool Bond. As provided by 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $ 120,000 in the form of a letter of credit posted for Phase II will be reduced by $ 96,400.

This bond reduction request is based on the following Phase II (3 to 4 years of growing seasons) reclamation:

1. Types of Reclamation Work Performed - the areas proposed for bond release/reduction have been reclaimed, revegetated, and the post-mining land uses have been achieved.

2. Appropriate Date(s) of Reclamation Work Performed - Seeding was done on the following dates: 11/4/19, 11/18/19, 8/6/20, 9/14/20. Trees were planted 2/19/21

3. Description of Reclamation Results Achieved  Results Achieved - Seeded.

4. Description of the Post-Mining Land Use - Agricultural-Grazing Land, Residential, Unmanaged Forest, Fish and Wildlife Habitat-Wetlands and Developed Water Resources.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any federal, state or local government agency or authority, may within 30 days of October 11, 2024 submit written comments or objections concerning this application and may also request, in writing, that the Mined Land Repurposing Program hold an Informal Conference concerning this application.
