The object of this suit is to declare that pursuant to Section 64.2-308 of the Code of Virginia Duane Richard Gardner is barred of all interest he may have by intestate succession to share in the estate of Joshua Ulysses Grant Gardner due to Duane Richard Gardner's desertion and abandonment of Joshua Ulysses Grant Gardner.

An Affidavit having been made and signed that the whereabouts of the defendant, Duane Richard Gardner, is unknown, it is hereby ORDERED that the defendant appear on or before November 29, 2024, and do whatever is necessary to protect his interest in this matter.

It is further ORDERED that this Order of Publication be published once a week for four (4) consecutive weeks in the Coalfield Progress, a newspaper of general circulation in Wise County, Virginia.
