    IN EXECUTION of a Deed of Trust dated the 27th day of August, 2018, in the principal amount of $25,000.00, recorded in the Clerk's Office of the Circuit Court for Wise County, Virginia, as Instrument Number 201804236, and the undersigned having been appointed Substitute Trustee under Instrument No. 202404307 recorded in said Court; default having occurred thereunder, and having been requested to do so by the Beneficiary, the undersigned Substitute Trustee will offer for sale at public auction at the Front Door of the Wise County Courthouse, 206 E. Main Street, in the Town of Wise, Virginia, [NOTICE: THIS SALE WILL NOT TAKE PLACE ON THE PREMISES OF THE PROPERTY BEING SOLD]
on the 30th day of 
December, 2024, 
at 11:30 A.M.
     All that certain lot, tract or parcel of land, together with all improvements situate thereon, lying and being in the Village of Roda, in the Richmond Magisterial District of Wise County, Virginia, and more particularly bounded and described as follows, to-wit:
    BEING Lot No. 167, BEGINNING at a fence post, a common front corner of Lots No. 166-167, having Stonega Coke and Coal Company coordinates, N 45663.48 E 42706.08; thence S 33-07 W 59.57 feet to a stake; thence S 33-30 W 31.80 feet to a stake; thence N 68-54 W 54.79 feet to a 16 inch cherry tree; thence N 10-28 E to a 18 inch willow; thence N 29-02 E 32.63 feet to a stake, a common back corner of Lots 166-167, thence S 56-57 E 84.49 feet to the point of BEGINNING, containing 0.162 acres, more or less. TAX ID NO. 016271.
   This conveyance is made subject to an easement of a right-of-way in favor of Appalachian Electric Power Co.
   There is also GRANTED to the Grantees the use of any and all easements, rights of ways, roadways, water rights, pipeline rights, sewer systems, including field lines attached thereto, in existence and which lawfully may be used by the Grantor, whether by express grant, prescriptive use or otherwise, and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
    Being the same tract or parcel of land conveyed unto John Q. Davis and Mavis A. Davis, husband and wife, as tenants by entireties with rights of survivorship, by Deed dated December 1, 2013, from Christopher Darrell Mabe and recorded in the Circuit Court Clerk's Office for Wise County, Virginia, as Instrument #201400089, reference to which is hereby made. Both John Q. Davis and Mavis A. Davis are deceased and there is no Will, List of Heirs or Real Estate Affidavit of record.
    There is also conveyed by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.
   This Deed is made subject to any and all existing reservations, easements, exceptions, conditions, restrictions and/or adverse conveyances as the same may lawfully affect the above-described property.

    TERMS OF SALE: Cash. A deposit of 10% of the sale price in cash or certified check may be required at the time and place of sale with the balance of the sale price to be paid at settlement, to be held within THIRTY (30) days from the date of the sale; should purchaser fail to complete purchase within 30 days, the deposit is forfeited and the sale subject to termination or a charge of daily per diem interest thereon until closing date at option of Lienholder. The property and any improvements thereon shall be sold in "AS IS, WHERE IS" condition without any warranties. Title shall be transferred by Special Warranty Deed, and Buyer shall be responsible for all costs of conveyance including but not limited to deed preparation and all fees to transfer title. Sale is subject to such additional terms as Trustee may announce at the sale.
    This is an attempt to collect a debt and any information obtained will be used for that purpose.
