     In execution of the Deed of Trust in the original principal amount of $185,077.00 dated October 10, 2016 and recorded as Instrument No.201702388, of the County of Wise land records, the appointed Substitute Trustee will offer for sale at public auction at the main entrance of the Wise County Circuit Court located at 206 E. Main Street, Wise, VA 24293 on August 12, 2026 at 1:00 PM, the property described in said deed of trust, located at the above address and more particularly described as follows:
   The following described property with improvements thereon and appurtenances thereunto, lying and being situate in Wise County, Virginia, and more particularly described as follows, to-wit: 
     ALL THAT certain lot, piece or parcel of land, containing 1.98 acres, more or less, more particularly described as follows, to-wit: BEGINNING at an iron pin in the East side of Crab Orchard Road said pin being a corner to property now or formerly of Charles Kiser; thence along the East side of said road North 40 degrees 56` 20" West, 398.48 feet to an iron pin corner to property now or formerly of Marie Buchanan; thence with said line North 38 degrees 48` 00" East, 133.18 feet to an iron pin; thence South 43 degrees 53` 10" East, 30.38 feet to an iron pin in the center of a twenty foot right-of-way; thence with center of said right-of-way North 29 degrees 58` 40" East, 57.50 feet, thence North 23 degrees 05` 40" East, 71.16 feet to an iron pin corner to Tract 2 (referred to as Lot 2 in that certain Deed recorded in the Clerk`s Office of the Circuit Court of Wise County, Virginia, as Instrument #201300281); thence with said Tract 2, South 56 degrees 14` 50" East, 219.12 feet to an iron pin in the said Charles Kiser line; thence with said line South 13 degrees 54` 40" West, 137.33 feet to an iron pin, thence South 13 degrees 32` 10" West, 112.70 feet to an iron pin; thence South 08 degrees 39` 20" West, 133.08 feet to an iron pin; thence South 54 degrees 33` 20" West, 3.45 feet to the point and place of BEGINNING, all as more particularly shown as Tract 1 on that certain plat of survey recorded with a certain Deed in the Clerk`s Office of the Circuit Court of Wise County, Virginia, as Instrument #201300281. TOGETHER WITH AND SUBJECT TO the rights of others in and to the use of any and all easements, rights-of-ways, roadways, water rights, pipeline rights, sewer systems, including any field lines attached thereto, in existence and which are appurtenant to an part of the use and enjoyment of said property. 
   Subject to all restrictions, rights of way, easements and other conditions contained in deed forming the chain of title to the caption property.

     The property and improvements will be sold in “as is” physical condition without warranty of any kind.
     TERMS OF SALE: A non-refundable bidder’s deposit of 10% of the sale price or 10% of the original principal amount of the subject Deed of Trust, whichever is lower, by cashier’s or certified check, required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier’s check within 15 days from sale date. Except for Virginia Grantor’s tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit by the Substitute Trustee of the conduct of the auction itself as well as the status of the loan secured by the Deed of Trust, including, but not limited to, determining whether prior to sale a bankruptcy was filed, a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.
